Still no cheque in the post, I'm giving it until Thursday.
I have a hand written receipt and also a copy of the receipt from the cash machine which was literally 100M from his house - so enough evidence if this needs to get nasty.

That is completely out of order, once you had left a deposit and got a receipt the car should have been removed from sale pending full payment on collection.
I sold my Subaru last week and I had a viewing arranged for a 5pm but another prospective buyer called me at 4pm to say that he was on his way despite making no prior arrangement, I did state that someone was already on their way though and he had an appointment booked. He arrived at my house at 4:30 & I then had to hold him off until the original viewer arrived as arranged and I wouldn't show the the car to the guy that arrived first until the original viewer had viewed it and made his decision.
I had made an arrangement with the original viewer and I wasn't going to allow someone to jump in there first because that's just not fair, the guy that arrived first wanted to go for a test drive but I had to refuse that too because I had intentionally left the engine cold for the original guy to hear it from cold.
It was a very awkward situation for me but it's how I would expect to be treated if I had already made an appointment and I had stated that I was at work until 5 so 5 was the first appointment of the day. That is the way it should be!
Luckily it all worked out and the guy that arrived first accepted that the other guy had decided to buy it, he had a wasted journey but he seemed to accept that.

I'm 6ft tall, 16 stone and bench 120kg and dead 160kg so am not built like a stringbean. In fact I'm a fat git. I am however a polite, respectful person without a bad bone in my body - maybe this is an invitation for people to feel they can take the mick.
As Paulo above, most people as seller or buyer are generally morally guided and have some ethics to the way they do business. Always that 1% though.

Years ago I sold a fully working race prepared MK1 mini at a bargain price as I needed the space, complete with 2nd immaculate shell, working installed turbo engine conversion, many bespoke parts, spares etc etc. Seller left me a (small) deposit and said they would arrange collection asap. The weeks ticked by with no contact about collection even after me chasing. Someone else contacted me out of the blue to say that my car with all the bits exactly as I was selling it was up for sale on another website (Advert had been copied and pasted from mine). My buyer was trying to sell my car for WAY more than he had agreed to buy it from me and before he had even collected it from me!
Needless to say I contacted him with an ultimatum to collect the cars & bits the next day or I would refund his tiny deposit & sell to someone else. I'll let you all know tomorrow if cheque comes, if not I'll be naming and shaming including full address and phone number plus everything I know on him.
I'll happily go through small claims as I have no doubt in my mind the legal fees will be his with the evidence I have. Even me handing the cash over would have been on CCTV at his local Spar cashpoint

Did you go in the owners house?? And did the V5 match the address you was at etc etc???
My mate years ago viewed a car with intention of buying, left the deposit and when it come to picking up the car, the guy had done one and kept the deposit, and no one living at the address he viewed the car at. Not trying to say he has done that, but if maybe he needed to keep you at bay until he left the house or something!!! Just sounds a bit fishy to me!!
Just hope the cheque arrives and you get your deposit back!! Not nice to hear when people get messed about!!! And good luck finding a car!!

I feel for the OP. I've recently been in the market for a run around and was, frankly, amazed by the lack of honesty and integrity on display. The highlight of which was probably a situation where I found a car about 150 miles away. Phoned the seller and asked if he would consider giving me first refusal in the time it would take me to get there and would not leave until he confirmed this was acceptable. "Yes", he said, "I will tell any other parties that I'm not available to show them the car until after you've had a look - I totally appreciate you don't want a wasted journey."

Er, that's not what was agreed was it!!
I would estimate that 80% of the adverts I saw for cars that I subsequently viewed misrepresented the vehicles or told an outright lie: One blamed a dealer for clocking a car. Another (advertising low mileage as a USP) hung up when I asked if they'd mind me checking the VOSA record of MOTs to confirm the mileage. Another said the car was fine, but upon driving it, the turbo was completely non-functional. When challenged he said, and I s**t you not. If you put a deposit on it, I'll get it sorted".
Seems like it's too much to expect a bit of common decency as standard when buying a car!!

I told them they were second in line after the chap I'd promised first refusal too (the right thing to do) Result: The guy who had first refusal pulled out after his insurance said nah and the chap who had offered to buy the car was seduced by a 911 turbo in the interim and got that. I lost out financially by not letting the second guy have the car, but I did the right thing morally and would do it again in a heartbeat because I believe someone's word should be worth something!

Someone round here pulled a similar stunt with a black R32 in the NW. Had agreed a price after seeing it, got the funds mobilised and was going down to pay for it after work and as I came off the roundabout round the corner from the garage his wife phoned told me he'd sold it for about £100 more. Fair enough no deposit but I did tell her what I thought, and that I should have marched in and told them in person! I see that car around all the time too.
But it's not just cars either. Some *** estate agents did the same thing to me when I agreed to rent a property when I was doing max fax at the hospital. I found a place, put a deposit down and had agreed to move in and arranged to live with a friend for a bit. Two days before I was supposed to move in he was like "hey bro, some geeza wants to pay £50 a month more to live there can you match that?". When I said I wouldn't and had a signed contract, he goes "well you better come down and get your deposit back then". It was not worth pursuing.
There are some grade A ***** out there, no morals or professionalism.
But it's not just cars either. Some *** estate agents did the same thing to me when I agreed to rent a property when I was doing max fax at the hospital. Sad to hear other people's stories too. I'm still hurting, as pathetic as that sounds, but I had my heart set on the car.
I couldn't resist texting him tonight, just a one liner saying no cheque received yet, presumably I will receive tomorrow? Was met with a response that it was posted 1st class Monday. Ergo I should receive it tomorrow - we'll see.

Here is the car: Was up for £8500, only 55,000 miles, stage 1 map, mint condition, stainless exhaust, detango, FSH, cambelt done 5,000 miles previous. Absolute steal for £8500. I haggled down to £8200 due to the bumper needing a spray where he had marked it, but nothing major. In hindsight, I should have paid asking price but hindsight is a wonderful thing. With hindsight I would have too cash down and driven it away there and then. It's human nature to haggle price.

Hopefully karma will kick in, e.g. the car blows up or something (not that I wish that on the new owner, of course).

The funny thing is I even said to him is he a member on Scoobynet and he said yes. My words were literally, "theres some good guys on there, it's nice to see if one of them gets conned by some shady character they all band together and support one another".
Hope he sees this thread. I also hope the new buyer also shows his face asking for advice as I still think he knew what he was doing, the advice I'll be giving is to pour 1KG of sugar in to his fuel tank to make it go faster...
Time to move on though. I'm sure another widetrack is out there just as nice.
