I'm not defending the thieves, not by any stretch of the imagination. I'm defending the element of common sense that says summary execution carried out by the victim isn't right.

Just because they are criminals doesn't mean you should be able to chase them down the road and shoot them, that's crossing the line from what constitues self defence in my eyes.

Agree that the 80 year old was in the wrong to execute the intruder.

However, it doesn't sound like murder. It was incited by the intruder over the previous burglaries and violence used. Like someone else said, he probably went further than he should have to prevent such incidents happning in the future, I think that's a valid state of mind to be in. Some people are scarred for life by such events as burglary.

Manslaughter at most.

sorry - but your post makes no sense - if you execute someone, as you say in your post

it is murder (in UK law at least)

your post only makes sense (but is till wrong imo) if you replace execute with shot
