How the non genuine part was sold as genuine through the Subaru network is not the issue.
The issue is how Subaru UK have dealt with the mistake, a mistake which was compounded by them confirming part was genuine when it was not prior to me fitting it.

I have come across various instances which mirror your own but never with such dire end consequences.
I wish you well when you have your day in court although I suspect that it might well be settled out of court before than happens.

I have not missed the point, I agree that you have a very valid case against the supplying dealer - I have only tried offer a probable reason as to why you ended up with a spurious part in place of the genuine article.

I hope something can be worked out and then the dealer gets compensated by Subaru UK, because although legally my contract is with the dealer I know, and the dealer knows, it is Subaru UK who are really the ones to blame for what happened.
Still my warning to Subaru owners is take note:
A) do not presume all dealer parts are genuine just because you pay main dealer prices.
B If you have problems with your Subaru don't expect Subaru UK to be reasonable or helpful.
