If I were you I'd report it to the Police pronto, if you don't report an accident fault or non fault your insurance may not pay you out as you mentioned above. If you are fully comp then I'd make the claim on your insurance, let Tesco do the legal stuff and shaft this **** of a cavalier driver IMHO that is.
The question is, Do you want your Subaru put back to yesterday mornings state prior to leaving your house ?? Well mate I think you need to do the correct thing......

Another thought, if he is driving around without an MOT it could be that his car has / would fail the test on something that would prove v dangerous (poss even a contributory factor in this case). If he is allowed to continue on the roads, he might kill someone next time in his illegal car. But, I am sure he would show a lot of remorse, again.
I couldn't have it on my conscience that I could have stopped this guy if he did do something else. You might not be the first yourself!

After reading all your valued replies, I think my course of action will be to let Tesco deal with it all and get a mint repair on the Scoob through a main dealer.
Why should this tw*t get away with it ? ..... maybe it'll teach him a lesson to keep his car fully road legal and to stop tailgating !!
Don't know about informing the police....I suspect as no one was injured they wouldn't be interested anyway....

Question is, do you want to have revenge off him?
If yes, then do what you can to make his life a misery (legally) but bear in mind that it might take a while to have everything sorted out and due process done & you still might not be happy or satisfied.
If no, then accept his offer of payment, but only as long as the repairs to your car are done at a reputable garage & to your satisfaction.
Some wally did a u-turn on me in a busy street in E.London. Battered old escort & crunched a grands worth of damage off my front wing. Police came, documents produced, PNCs etc. Both sides legit. 100% not my fault. Chap phoned me up the next day & offered to pay for the damage. I stipulated as above, went & got 2 comparative quotes from people I would be happy to have fix my car, told him.
He came round to my office with £950 cash
Don't know what his reasons are, I daresay to do with NCB & insurance history, but at the end of the day, my car was fixed to my satisfaction. It would've been totally unneccessary to seek to make the chap suffer further when it was a mistake on his part.
It happened the other day too, when a bloke stove the door-panel of the Vectra in at a petrol station. It was a mistake, he was genuinely sorry and rather than make him suffer, I questioned if he had someone who could do the job, he had, so they did it. 100% OK fix & he got it cheap from a m8 (did check the garage first though ).
It may be that he was an a$$ driving too close behind, but if he genuinely wants to make good his mistake, then my recommendation is to take that course of action. You are still able legally to persue him for recompense if it goes pear-shaped. IMHO you are lucky that he wants to do so, as I've been knocked off my bike by someone who gave false details & I never found them again [img]images/smilies/mad.gif[/img]

O.K he was an ****, But people do forget about the little M.O.T document, They get a nice shiny new one put it away & forget all about the expiry date until something prompts them, Take his money get a good quality job done on your scoob & forget it.

Sounds dodgy... Go through the right channels, ie your insurer.. let them sort it..

However, in this guys situation he knowingly took to the road in a potentially none road worthy vehicle...AND drove like a ****..

Same thing happened to me when a boy in an old xr2 hit me whilst i was stationary at traffic lights.
I went through my insurance, they said they would claim it back directly from his insurance/him (his insurance was not looking very legit/legal). That was SEPTEMBER 1999. It only got sorted after solicitors/courts about TWO MONTHS AGO
That was after i chased it on phone, wrote letters etc at least every month for what turned out to be nearly THREE YEARS.
If he is offering to pay then let him, get Three quotes from three places that you would be happy for to fix your car and let him chose which one he wants to use. Get cash off him before any work is done.
Also insist that he pays for a hire car unless you have alternate (free!) transport. That kinda thing will take at least a week, if not more, especially if they have to put it on a jig. I wouldnt be suprised if they had to straighten it a bit on a jig as cars are made to easily crumple when hit from back/front......mine did and he only hit me at 20mph. The only visbale damage was slightly dented/scratched bumper/bootlid!
If he wont agree then i guess you'll have to go through the official route, if so then good luck and i hope that it doesnt take as long as mine did.

The MOT is there to protect us all - what happens if one of his ******* wheels falls off and kills someone because he STILL hasn't bothered to get MOT & Insurance. This could be one one the ****** we always read about the gets ban after ban for driving like a **** and nearly killing folk and ignores all bans etc until he does (Kill someone) - then we all say "Oh If only we could do something about this"

Must say many of you are a being a bit vindictive here? Yeah Mr Cavalier screwed up, but is that a reason to persecute him further? We all screw up now and then... I have forgot the number of times I haven't had tax or an MOT for a few weeks at a time after all.
Charge him £100 for your leniency in not reporting him to the cops, and get the cash NOW (at the bodyshop) to pay for the fix. It will be quicker in the long run, and you will have done someone a favour too... What goes around...
If I come up behind a 'I own this lane, and i'm not shifting' type car on my 900 they get a toot of the horn and get called a twa* at the next traffic light. It's not worth the hassle in Special Constabling the speed limit (not that YOU were) - it'll end in more grief...

Go through the proper channels!! Similar thing happened to me a couple of years ago. The driver of the other car said he was going to pay it, then deceided he would try to give it to me in installments. This was obviously not the agreement, and ended up with me getting a cheque from his wage packet, but the useless tw@t got the sack before he had earnt enough so I was still out of pocket!! So don't trust these people to give you cash, if they ain't gonna pay their car bills they ain't gonna pay you!!

The words 'Battered Old Cavalier' make me reckon that the guy was too dodgy to bother getting his car re-mot'd on time as being a Vaxhall, it would fail on a million and one things. When you run the gauntlet, you run the risk of getting caught. If you get away with it then lucky you, if you don't then it's your own bloody fault. You are BREAKING THE LAW. Simple as that. I hope that your car gets fully paid for and the muppet get's what is coming to him. Either you will be kind and give him the chance to pay for it, or you will do everything above board.

Although there are some very different ideas out there, I'm convinced that the best way to go is keeping it all above board....through the insurance. After all, isn't it for occasions just like this that we pay insurance ??
I have a gut feeling that if I get into the scenario of letting him pay cash, it'll all go **** up somewhere along the line....

Not to put too finer point on it, screw the f*cker into the ground. His 3rd party insurance is there for that reason, but if he's invalidated it by having no MOT that's his problem, not yours.

IMO if he has got a battered old cavalier with no MOT then he won't have the cash to pay for the reapirs especially as you are probably looking at £1k+ for a good job.
I would be to worried about it going **** up if you let him pay for it. You could always say, when you have got some quotes, that he has 5 days to cough up otherwise you will be going to the insurance.

I go with the "above board" boys on this Steve - Dirty Wrong 'un summarises succinctly and well. If the Muppett tries to renege on his 'deal' with you, you are left holding the baby.....
I think that failing to report the accident to Police, particularly if there are prima facie driving offences by the other party, leaves you in the wrong with the Law, tho' doubtless Burr (If he's reading this thread) would confirm or deny.

Well, i was hit side on by a disqualified and uninsured driver, i had my new (ex demo 306 GTI-6) for a grand total of 2hours and 30 minutes [img]images/smilies/mad.gif[/img] this F**ker left me with bad back injuries that took over 3 years to sort out and even now i still suffer, over 5 years later [img]images/smilies/mad.gif[/img] so if you think its right to let this sort of person get off scott free then feel free to let them hit your car, maybe they will take you out completely and kill either you or one of your family/friends [img]images/smilies/mad.gif[/img]
