Shunted from behind - How can it be my fault?
#31
I was recently rear ended
I didn't feel any initial pain
But the following day started to feel my some pain in my neck
I have since visited a chiropraticioner and who has helped imensly
But someone has to pay his bills £25 a visit [at least 8 visits required]
He however informed me that is amazing how many people come to him with "whiplash" he saids any reputable chiropratic could tell a false claim within 2 mins

i was in an accident 2 weeks ago, at the scene i didnt feel a thing apart from gutted, thats down to the adrenalyn im sure. But i had i real bad neck up until about now the morning after. So i know you can get it, its the people that dont that pi55 me right off.
And as for the chiropracters costs, i totaly agree. Im talking of the people claiming 2 to 5k or more, whats that to compensate for?
Ps i never made a claim before anyone asks

I thought that if you are involved in any rear ender then it is always the person that goes into the back of you's fault as they where not paying attention, but I dont know where you stand as you swerved into their path and they may not have had enough room to stop or their cars brakes weren't up to the task of stopping at such short notice, unfortunately I think the insurance company will go 50/50 as its difficuly to prove as its your word against his.
Sorry.

Sorry I just read the post again and realised that you said the guy made up the story, I would contest this and get the legal people involved(did you have legal expenses with your insurance?), other than that with your word against his its 50/50.
I hope you get a result as the other bloke is a to$$er!

Thanks for all the advice, I guess I'll just have to wait until the solicitors fight it out and then appeal to the ombudsman if it doesn't go my way.
I don't like the idea of the UK turning into a litigous society like the US. I did suffer whiplash and put it on the claim form but it was really just to record the fact that the accident caused me injury rather than to get money for having a sore neck.
I just hope this post will serve as a warning to others, there are some scumbags out there who will make dishonest claims at our expense.

Sorry to hear about your accident, but as I did when a guy ran a red light and hit me recently, the first thing I did, even though he was sat on top of a traffic light, was jump out of the car and find a witness.
Even if the other driver looks like they are in trouble/injured etc, if it was their fault, spend the first few seconds finding someone to confirm your story.

I have recently had a problem similar to this but in my case I was turning right into a shop car park and was hit on the right hand side of my car, the guy persuaded me to not call the police and was all nicey nicey at the scene, but when I submitted a claim he got really arsey and started making stuff up. really wish I'd called the Police and it may be a slight waste of a coppers time but if I get hit again I'll be claiming i'm hurt and getting the plod to the scene even if i subsequently don't claim for the injuries.

<If you have an accident on a motorway, by law you MUST call the police whether someone is injured or not.> where do they gat these ideas.
Most of the M4 is covered by Police cameras, contact the control room of the Force covering the area you had the accident see if they have it covered.
Stick to your guns let him prove it
