Scooby96, All very good advice and having followed threads in the Technical area this is the advice people have come up with. I was wondering however if this is the way that a Subaru technician working in a dealers would go about an oil change? Can anybody confirm? Shark? (sorry to pick on you). I would be surprised if they do that's all.

Under the law you are entitled to a full refund or to get the faulty goods repaired free of any cost to you. This only applies if you bought from a garage, which have to abide by law to the sales of goods act.
PS don't take it anywhere for repair until you have reached an agreement with the supplier, as this will invalidate any further action you take.

Raggy, I'm afraid that isn't the case here.
No contravention of the sale of goods act had been commited.
When the car was test driven and purchased it was in good working order, as Mad Gypsy will attest in his posts telling how fast and great the car was.
As soon as the car leaves the dealer, any problems are warranty issues, providing you have one.
Once the tyres cross the dealers forecourt, technically you are the owner, and if it goes pop 100 yards down the road it's tough cheese. Unless you have a warranty, which luckily, Mad Gypsy does.

The car is V4 98 S with 23,000 miles.
I was told that by law the garage would have to fix the problem or refund the full purchase price if the fault is within the first 90 days. This was by an ex car salesman.
I hope this is the case because my warranty is with Warranty Holdings. Need I say more?

Let us know how you get on with the warranty, I have been told by many people that these warrantys aren't worth the paper there written on. Like any insurance company they will do anything to wangle out of it.

Hi. What raggy said is true. if you buy a tv and it pops in a couple of days, under the sales of goods act it will be replaced, repaired or refunded. It is no different with a car. the period I believe is 14 days after you collect the goods for a refund. As long as you have done nothing to the car that would cause any engine faliure you are by law able to exercise your 3 options.
Try the Citizens advive bureaux they will give you the correct advice, and how to deal with the dealer.

I did check the oil, it was at the correct level and had that new clear look.
I'm sooooo p!ssed off right now, I don't have any car and won't have one for the next four weeks, and that's IF the warranty company pays up.
This time last week I had a fully loaded 98 BMW 328i Convertible that was the pup's nuts.
I know that this is not a reflection on scooby's, but I kind of wish I still had my beemer.
Having said that, this experience has not put me off scoobies.

If you part ex'ed the beemer, i would want it as a curtacy car from the dealer (if thats whos sorting your warranty etc). youve only had it a few days!
I think i would of given the car back to them and if it was repaired properly then maybe buy it again (for the same price)

They have sold my car already, as that was my first port of call, to get my BMW back.
I will only have a scooby specialist work on the car.
The garage said they would repair the car and I said no.
It took them a full day to change the water pump, so I'll be buggered before I let them rebuild the engine.
If the garage or the warranty company won't pay for Roger Clark's to do the work then I want a full refund on the car.
If either try and fob me off I'll sell my house to pay for the leagal bills before I'll let the b@stards put one over on me.

That is good advice from Scoob96 about the oil change. I doubt very much that the average Subaru dealer's mechanics would go to that kind of trouble which is why I always change my oil myself.

Water pump change is a cambelt off job - the first thing I'd do is tell the place that is inspecting your car for the cause that the water pump had been changed.
I wouldn't let anyone except an experienced Subaru mechanic do a water pump change. However, you did mention that the car was going well so I doubt the belt was put back on incorrectly - having said that I'd get the tensioner checked out ASAP.
Just an idea.

Thanks for all the help and advice everyone, but it looks like my scooby ownership days are over (all 4 days!)
The warranty will not cover the cost nor will the garage.
The garage have offered me my BMW 328 Convertible back though.
I'll have to take this as it is now the only sensible option.
Who knows, maybe one day I'll be behind the wheel of another scooby.

So how did they manage that? I assume they managed to fob off the new ower of your BMW with a reason why they can no longer have it.. I wounder what they told them.

If the cars' 'blow up' during the first week, can't you claim it is 'not fit for purpose'? Spk to a Solicitor - the fee they charge may be worth it so you know your ground if you get into any disputes later on with either the garage or warranty company....

Some good news on the scooby front.
The dealer agreed to pay the full price of an engine rebuild to be done by Barrett Motorsport in Canterbury.
It's going to take 5 weeks, but it will be worth it if the car is right. Barrett's do come highly recomended.
The day after my car blew up my kettle blew up, and the day after that my printer blew up, and tonight I ripped my best trousers p!ssing around on a bike!
It has to go down as one of the crappiest weeks in a long time!!

Glad to hear about the rebuild. That is a bit of a wait but you will find it is worth it. Only thing is the running in bit, but worth being patient and doing that properly too.

My engine started to knock on way home from meet on friday night, already got engine out and stripped, cause of this is not the map or the fuel, it is in fact the oil pump. When you get it rebuilt use an uprated oil pump.
the pressure relief valves appear prone to sticking, causing loss of oil pressure, the hydraulic valve adjusters start to get starved of oil, so the rattle starts, then the big ends go!!
