Sorry to bring up the rights issue again. Have just been speaking with a mate of mine who has recently split up with his wife. They are still living in the marital home with their 2 young children, he has been told that if he moves out, he will have to continue paying the full mortgage [altho it's in joint names] and also that the courts 'could' make him sign over his half to her for the time she remains there whilst the kids are still receiving full-time education. Then his half will revert to him.
Surely this can't be right?

Nope - with a decent brief she could get a 60/40 split of ALL the assets (ie pension, savings, shares, car etc etc etc).
If I was him I'd stay put and see if she moves out - although hes probably gonna have to sell the house unless he can buy her out.
Being married and getting divorced = being stuffed financially.
Being married with kids and getting divorced = being doubly stuffed financially

He needs to stay put otherwise he will jeopardise whats rightfully half his. Its seen as deserting the home and that could make a judge award more in her favour.
Perhaps a string of young floosies (when the kids arent around) might make her move out and accept a 50/50 split. If she doesnt work then yes she could get awarded a very generous alimony payment as he is obliged by law to continue to pay for her and their kids standard of life until the kids are 18 or leave FT education.
Either way he's got it tough as have her and the kids - best to try and sort this out between themselves otherwise all they'll end up doing is lining the pocket of the lawyers.

I thought if it was in joint names - both parties were responsible for the mortgage payment.
e.g. if he suddenly became unemployed - she would have to pay it if she was working. If nobody is working mortage protection insurance kicks in and last for a year starting a month after unmeployment.
Have had seven-eight mortgages and this is what I have in writing.

Its poss shes not working hence the reference to "2 young children". If thats the case then the mortgage co wouldnt get much joy out of her would they. Joint and severally liable I think the term is - however they would more likely persue him as hes the main bread winner (I'm assuming here ok so no sexist remarks please).

Bet she won't let him do that either.
Its when it gets to this stage that it gets nasty and the man could decide to claim that the woman is an unfit mother - drinks in front of them, has men friends, hits them etc.
Like you say, with not being happy to pay for his own kids, the only real losers here are the kids.

He can't possibly afford to move out, he's not in a particularly well paid job, well not one that allows him to pay full mortgage on the marital home. also rent somewhere for himself and pay the extortionate rate that the CSA expect him to pay......

For 2 kids he will be expected to pay 20% of his disposable income. You can force a house sale in exceptional circumstances - ie it not being financially viable and therefore avoiding a repossession. Although it may be nasty at this stage its going to get alot worse unless they both sit down as adults and realise that they will both end up in far more debt the longer this rumbles on for.
Dont envy them at all - I have been through a divorce but thankfully there werent any kids so it was easy to walk away. Saying that I lost at least 20k and the car!!!

It is right that she can make him pay the mortgage until the kids finish full time education or until she moves another partner in or gets re married. I had this option but didn't take it as it wasn't fair. All this staying put in the house is b*llox! My ex moved out and he eventually got the house and payed me 10k (half the equity), so don't think that all men are hard done by!!
