The 14 day limit only applies to the registered keeper. If you are the keeper, the NIP is 'out of time'. If it comes to court, this is your defence.

I understood that galv was stopped and spoken to by the police at the time. If this is correct, there is no requirement to send a NIP within 14 days, as he will have been given a verbal NIP at the time. Even if he wasn't, plod will just lie and say he was.

I thought the cops only had to prove the NIP had been sent out within 14 days of the offence and not reach you by 14 days?

Galv,

You will receive a ban, so best to prepare for it. Between 30 and 40 mph over the limit the magistrate has discretion to give you points in lieu of a ban, but over 40mph over, you will get a ban, they only have discretion how long a ban they give.

Realistically you should expect about a 6 week ban, +/- 2 weeks depending how good your solicitor is. Everyone pleads says they will suffer great hardship without having a car, risk of losing job etc, the magistrates hear it every day so don't expect miracles.

18 months ago I got done for 46mph over a 70 limit. Solicitor presented mitigation, couldn't get to work by public transport, was a salesman so couldn't do my job and letter from my MD saying job at risk if a lengthy ban. Got a 6 week ban and 250 quid fine.

I had to rent a room within cycling distance of work as couldn't get there any other way. Paid for the room from the petrol money I'd saved, and I got fitter - so look on the bright side

Best thing you can do is get a road traffic solicitor. I used these and they know what they are doing.

I filled in the form and requested representation at court. I was contacted the nextday by a solicitor.

You need to do this.

Good luck, its amazing how quickly these high performance motors pick up speed. It's easily done.

With all due respect to Greasemonkey, I actually live in the country and these roads are the way we get from A to B,if there are no circumstance s under which 60 mph is a safe maximum limit why have the limit? I was also not referring to cyclists or groups of cyclists behaving in a sensible manner,rather large numbers of them (perhaps from a cycling club?)travelling in packs,,4 and 5 abreast ditto horse riders 2 and 3 abreast.The reason they aren't allowed on motorways is because it isn't safe for them to be on them,only 10mph higher limit,no blind bends etc?.If wanted to be a race or rally driver I would rune a race or rally car not a quick road car.Ref. test? you mean there's a TEST?(tongue firmly in cheek).Ref. tractors sounds good to me (ditto tongue/cheek)

Again, you are putting words in my mouth. I didn't say there are never any circumstances where it's safe to drive at the posted speed limit, I said there is an imperative to drive in a safe and considerate manner. If you have to slow down to 20mph on some corners, so be it.

You're really not getting this are you? It's a limit , no more no less. Not a minimum, or indeed a recommendation. As to "why have it?", well, likelihood is it's going to get dropped within the next few years, no matter who wins the next election.

They're never that bad round here unless there's a race going on - more like two abreast, three maximum. They're perfectly within their rights to ride two abreast unless the road is especially narrow. It's safer for them too, as they're entitled to a full car's width and taking it up makes you treat them as you would any other piece of traffic.

Both cyclists and motorcyclists need more space on the road than most motorists tend to give them. You might not care about or even notice potholes, draincovers or patches of oil but the two wheeled guys may need to avoid them, something you should be thinking about when pulling up behind or overtaking. Again, it's nothing more complicated than consideration and courtesy.

If I ever come upon a bunch like that, they'll invariably let me through soon enough. If you have to slow to 20mph for a minute or two while you're waiting to get past, who bl**dy cares? It's a country road, have a gaze round and take in the view. If your journey is sufficiently tight that you can't afford to wait behind them, you should have left a darn sight earlier...

No, the reason they're not allowed on them is because motorways are reserved for high speed motor vehicle transit, pure and simple. Cyclists and such are allowed on most dual carriageway A-roads - which also usually have a 70mph limit, so it's not the speed limit itself that bars them from motorways.

Really? Why are you talking like your journeys are timed to the second then? All this rubbish about being "slowed" by other traffic on your way from "A to B" makes you sound like exactly the sort of boy racer you claim you're not.
