Good luck mate take no notice of the To55ers on this site, you always get one **** and for some strange reason its always the same couple of people seem to slag someone off.

It wouldn't be too bad but it is always aimed personally.

Sad how people want help and sympathy when they break the law.

Don't get me wrong. I'll go too quick at times but I don't whine when I get caught. I knew what I was doing at the time. If I didn't I shouldn't have been behind the wheel.

R.B.5 you are gonna have to bend over on this one mate, there is no way you will get away with it on gods earth, i didn't and i was only doing a poultry 76mph in a 30 limit, cant understand how i got a two month ban, they didnt believe my throttle got stuck

Thanks for all the positive comments lads! Hopefully i'll get off, or maybe they'll be light on me! As i said before, i was doing the speed, so i'll take responsibility for it. If that means a ban then so be it.

Heres hoping i dont eh! Does insurance go sky high once a person has a ban on their license? Will i have a criminal record? I've been a law abiding citizen all my life, with the odd occassion of speeding where i believed it to be safe!

I was doing the speed on the M4 near where i live. The skyline had tints on the windows so i couldn't see much behind me. For example the Speeding policeman gaining on me. lol.

Elmer what happened in your case, its always good to hear other peoples stories as it kinda makes you feel better in a weirdish way!

Mr Lewis,

...your'e only jealous ,just because the only time the salonmobile will reach 120 is when thrown out the back of a C120, is no reason to slate the guy.

If someone gave me the keys to a Skline, and I found myself on a motorway, I'd more than likely do the same ( If I were fully comp of corse ). You're an unlucky irresponisble tw@t R.B.5, I hope they throw the book at you. [img]images/smilies/mad.gif[/img]

R.B.5... your situation sounds familiar...

I was accused of speeding in my friends car also; but I was on the way to dropping it off to my friends after collecting it from the garage.

The police car didn't follow me, it didn't have the technology on-board to record, film or track what speed I was doing... because the officer was travelling 85mph to gain on me after over taking 3 cars... he accused me of speeding.

I got a producer, I didn't know what it was at first because it didnt say on it nor did the officer tell me. I was read my rights and then nothing happened after I showed my documents at the station the next day...

Until 5 months after when I got an invitation to court... naturally I pleaded not guilty. It was postponed I I requested the officer give oral evidence because I wanted to see what the oficer had to say for himself.

Only one out of the two officers present turned up... after 3 hours it still did not matter whether the officer admitted he had no evidence whatsoever apart from because he had to travel 85mph to reach me 3 cars ahead...

The officer accused me of speeding and all else did not matter what he fabricated.

Conclusion; you are guilty before you walk into the british justice legal system... you have to prove your innocence.

The best advice I can give from my fresh experience is

1] when the summons arrives, request the prosecutors evidence and only then decide whether you want to plead guilty... because you may be able to reduce the sentence if you put your hands up and admit it.

i was only doing a poultry 76mph in a 30 limit,
120mph on a motorway is much safer than 76 mph in a built up area.

We all put our foot down from time to time. The traffic is all going the same way on a motorway, the skylines barely reving in top at that speed. If it was 120 in an old XR3i I could understand them hopping up and down as the cars right on its limits and the brakes, handling etc are crap.

Bad luck, Anything to do with speed and if you voted labour in the last elections and you deserve everything you get, If not ............

Sorry to hear about your bad luck.

It is unlikely your will get an NIP and much more likely that the police at the scene said something along the lines of "...will be reporting you for consideration for prosecution..." This is the verbal equivalent of the NIP.

If this is the case then they have 6 months to summons you. In my experience it often takes the best part of 6 months to get the summons to you but this depends on the area and work load etc.

The summons may well contain a statement from the police officer indicating exactly what they alledge you did. I would suggest that you get a solicitor with experience of traffic law. It is possible that the summons will be for speeding only but there is also the possibility, in view of the speed and depending on circumstances, of dangerous driving or other charges. This may raise the nasty possibility of time in jail and so really makes a solicitor necessary.

For a simple guilty plea a solicitor is likely to cost in the region of £700. You may also find that there may be some defence options open to you should you wish to go not guilty. You need to know the device that was used to determine your speed and you must also have some clear idea in your head of exactly what speed you were travelling at. For example a smart solicitor may be able to use video evidence to show that the police car attained 120mph to catch you but that you never exceeded, say, 90mph. While this will not save you from conviction it might save you from jail.

You must also be aware that police can be economic with the facts in these situations. I have first hand experience of them lying in court to achieve convictions and I am also aware of one case where a speed was recorded using VASCAR. VASCAR times a vehicle between two points but a clever solicitor established that the police car was parked such that one of the two points mentioned in the police statement wasn't actually visable from it's location. Basically the police had decided that the motorist was speeding and had constructed a suitable speed in their VASCAR device to assist with a prosecution. So, while they were not exactly lying that he was speeding they did lie about how they determined this and so the motorist was found not guilty.

A solicitor will demand the disclosure of all the CPS evidence and you should make sure you get as much as possible, not just a single photo from the video, for example, but the whole video. Even if you don't get a solicitor you should request disclosure as this is an area where police and the CPS sometimes screw up sufficiently badly to let you off the hook. Calibration details for the measuring device etc. comes into this.

The not guilty route is likely to be expensive in legal terms and in the magistrates court you are assumed to be guilty before you get in the door. However, when you consider the potential savings in insurance costs over the years it might be a route worthy of consideration if you believe you have a reasonable chance. Again guidance from a solicitor experienced in traffic law is necessary.

You seem to be very clued up on cases like these! There was no Video in the car at all. He had to open the glove box to get some producing slips. When i first went to get in the car i opened the front door. Then was told to get in the back. All i could see was an indicated 119.6mph on this black digital box. No bigger than a stereo front.

I think i was doing circa 100mph when i was actually pulled and that the device showing 119.6 was what his car was doing in order to catch me up.

I really hope it doesn't go any further than this. Me sitting here worrying about going to court is bad enough i may even end up in jail. I wont be able to handle that i dont think. Do i consult a solicitor now or do i wait until i have a court date?

I'm really stressing about it. Jail is the biggest worry. Doing time for speeding is just ludecrous, absolutely stupid when we have proper real criminals doing much more inhumane things that should be banged up.

God i wish i had a time machine!
