How about negotiating with the neighbours, maybe go 50/50 on the tree surgeon? Have you had any quotes?

Can you get any supporting documentation to state that it IS something to do with them and stress that you don't mind helping to pay for the tree surgeon, but you'd like to do something before one of the branches falls off and damages your roof / window, for which they WILL be liable.

Don't forget that if you fall out with your neighbours you will have to tell any prospective purchasers of your house that you have fallen out with them. This is unlikely to enhance the value of your house! :-D
Personally from that photo the tree didn't look as if it was over your house too much and I would put up with it. Silver birches don;t live long!
