Just my two cents: Its not entirely true that you don't have any comeback from a private sale. The seller must be truthful about the car and describe it accurately. If they claimed it was standard knowing that not to be the case and you have incurred losses because of this misrepresentation then you can claim compensation from them. You will have to provide evidence that they deliberately mislead you though, so if you don't have some kind of documentation, this might be difficult.
In future, always get a private car professionally inspected, no matter how mint is may seem! Also, consider a private warranty in future, not cheap, but then neither is a gearbox!
I hope you've not got your fingers too badly burned and wish you all the best with future purchases.
Best.

Sticky Micky: I simply did not realise how old the thread was. There is no need to be unpleasant- anyone would think I'd pi**sed in your petrol tank! :-) (fairly sure that's not covered under warranty either :-) ) You might be bored of the topic, but my comments on this important issue stand: Private sellers do have legal obligations to buyers and private buyers do have some protection under law- albeit very limited-compared to that afforded by a main dealer.
Best.

Why is everyone suprised that the gear box has gone on a 51 plate .
The engines are blowing up more often then the gearbox,s and that incudes the latest scoobs.Subaru do not seem to have this problem solved after 12 years of producing the impreza.Ive been reading these engine blown gearbox blown threads so often i wonder why anyone buys these cars .I have had one ,never buy another.Although they look the dogs handle well etc etc.Reliabilty is poor.

would like the to know the statistics for imports vs uk for engines/boxes going west and the percentage of those failures where the cars were completely standard.
also the original post said a second hand car with only a headlamp conversion. it is widely accepted the standard box is only good for 300 bhp/lb torque. what mods did the previous owner remove prior to sale? all the time on ebay you get full decat systems/chips being sold with the comment "removed from car before i traded it in".

they can't. subaru make them as fast as they can while keeping them reliable. if you choose to take your car beyond that something will break.
you would not buy a hifi and then add a much bigger amp that the speakers could handle. then blow them up and try to take them back to shop and expect them to give you new ones after using an overpowered amp. it would not happen.
i'll get my coat
flame suit on

I feel your pain, and dont' want to patronise, but buying a car - especially a sports car, without expecting the history, and exploring what has been done to it? Your'e asking for it, I would never buy a sports car of any type without really researching the in's and out's of what ot look for, and steer clear off. I am a bit shocked to hear you say you bought a sports car and didn't even know there had been mods? If you don't know much about the car, at least get an inspection done, it's about £100, but look how much you would of saved if they'd told you the gear box was on the way out, or mod's had been done.
The mods are like mentioned not exactly gear box crunching, however, obviously they're going ot invalidate any guarantee as with any marque (Subaru, are often actually very tolorant of mod's compared to most manufacturers - but that's another thread). The main thing mod's tell you, is that the previous owners wanted more power, which normally means they've been ragging it. I would speculate it had more to do with how the old owner treated the car, and how well it was serviced....
Can understand how you would be angry in general and specifically at Subaru, but being cruel to be kind, maybe there is a lesson for you in here, about buying second hand cars, and how much effort to put in to your research and testing before paying your money..
The MR2 owners website, has quite a large document they've put together about car buying in general but specifically about MR2's and they go into a lot of depth about what to look for, what bits go, what bits get weak and reading it sent shivers down my spine, off all the potential ways you can get fleeced buying second hand. It's not that often it happens, but it's the risk you take, and it is your responsiblity to lower those risks with research. At the end of the day from a legal pespective, unless you've been obviously mislead and lied to, it's a case of buyer beware.
Hope it doesn't leave too bigger lump in your wallet though, very expensive lesson to learn!

Let me know if you ned it, 30 something thousand miles on it, Perfect.
I hope you get some joy with the warranty, AFAIK, modifications are only an issue with the warranty if they are directly responsible for the failure of the parts.
Regarding the De-cat, haw may catalysts are missing, as the cars come with 3 as standard.
If they have all been removed, then technically your car is not road legal as it would not pass an MOT, and will definatley invalidate the warranty
If it's just one cat that has been removed, as per PPP, then it will still pass the emissions test so you should still be OK.
I live in Birmingham, if you wan't it I can quote you a price including fitting if you like if you can get the car up here, let me know what other prices you are getting quoted, I should be able to beat any of them, can get it delivered to you if you like.
I could give you a whole Engine and gearbox for just over half the 3 K you have been quoted, and you would then have a spare engine and go to town on as many mods as you like.
All the best mate

Id get the gear wheel teeth indipendently inspected by a recognise Inspection company, and get them to do you a report. If there's anything suspect around materials etc, you can give it to Subaru as evidence. They tent to take you a bit more seriously then ![Smile](images/smilies/smile.gif)

im have become peeved off now
I paid 28K for a shell of a car that cant be driven
what a waste of money - it is really ridiculous
i find the attitude of the Subaru Uk to be ridiculous -- its done 1300 miles, there was a gearbox noise at 170 miles, they should just swap it for a new box .
