Exactly!!

Friend of a friend story, but a childhood mate of his was showing off his new car with his best made in passengers seat one night, overcooked a corner and hit a tree and killed his best mate. Imagine living with that for the rest of your life! Needless to say, it ruined his life, and many others around him, what a hideous thing to have to live with.

Hardly bares dwelling on, but also bares keeping in mind occationally.

even if parts are stupidly dear surely that wont cost more than 15k to fix & as sum1 who knows little surely that wont be written off?

I hope it's not written off, as it'll be a real shame. I guess the only consolation was that she did'nt kill anyone in her drunken stupor. She could have done the same thing as she did and ploughed into a group of people

Drunk/Drug driving, there is no excuse for it.

Thanks for all the replys.

Insurance company has been in touch with her insurance company but for some reason its in the disputes file.

Anybody have any ideas why that could be?

I was told that it may have been coz its over ten grand claim.

Nope no hire car i have been offered one but i dont want one i have access to other cars so i think its not right for me to get a poxy corsa or something when ive got over 4 cars parked at home !!!

If the crash had been your fault than your insurance company have the option to fix/write off in line with their guidlines.

When a third party damages your vehicle you have a legal right to have the vehicle put back to the condition it was in prior to the accident , REGARDLESS OF COST, paid for by the third parties insurance, NOT YOUR INSURANCE COMPANY.

If you allow YOUR company to fix/write it off, and then let them claim the cost back fromk her insurers, you may well get the car written off.

If however you insist that HER insurance company pay directly to fix the car, you can DEMAND it is returned to its original condition.

Your insurance company might not want to assist you in pursuing this avenue of recompense, but I am quite sure that if you seek legal advice on the matter, you will confirm what I have stated is correct.

Write directly to her insurance company setting out your requiremnts for full and complete recompense, and that the only acceptable course of action you will accept is your car being returned to the same condition it was prior to the accident.

I read the article in the Daily Telegraph motoring pages quite some time ago. (years?)
They used to have a 'Legal' type story that went into detail about a specific topic.
I haven't still got the article, and I cannot find confirmation on Google, but I am still fairly sure the rule hasn't changed.

If I remeber it highlighted the older car type scenario, were the cars market value was low, but its usefulnes/value to the owner was higher (not neccesarily in monetary terms)

If you want to keep your car it has to be worth some interogation, or even legal advice.
If you are in the RAC or AA, they can give you free legal advice.

I know this is a stupid question but how can it be a right off? The damage can surely not out price the cost of the car. By the way mate very sorry to hear what that daft, evil, nasty, dangerous, inconsiderate, stupid, moronic cow did to your pride and joy. I hope she gets banged up for a long time. I got hit by someone who ended up doing a runner. Car he abandoned was not Insured or registered in anyone's name. I had to pay up myself cost and arm and a leg. I had just got my car right it was only a J-reg Legacy turbo...I was gutted so with that beautiful car I really feel for you. I hope you get a good resolution to it all. I live near Oldham Road in Manchester not the nicest of places and be careful pure cops with speed guns/cameras on that road and they are ruthless.

in a case where the police are involved and the other person found guilty of an offense, then It is 100 % their fault. As good as them saying "it was me, all my fault" I got hit like this and my insurer said they'd just pass it over to legal group, within 2 weeks my car had been repaired, all i had to do was sign that the repair was satisfactory. £1350 worth of damage to a £4000 car.

The reason they will be looking at it more closely is that you have stated you drove on the wrong side of the road, avoiding her or not you broke a road traffic law.

She may well try and argue that she simply lost control and was trying to get back on the correct side of the road and that is why she hit you.

Yes she was over the limit but remember they say you should never swerve to avoid an accident as you will undoubtably cause another, i know its daft but be carefull as her insurance will try to blame you for being in the wrong lane.

My opinion would be to screw her and her insurance financially to the floor.

Thanks for all the reply's and apolgies for the late reply.

Just an update that my solictor has had a engineer view the car and the cars been declared a write off also she has admitted fault.

My engineer has valued the car at £31k and £5k salvage value.

£175 recovery which i paid no storage costs no hire charges.

So her insuarance company are going to get a shock for when they recieve a letter asking for the amount above.

5k salvage value, is that the price it's worth now? OR the cost to get it fixed? (sorry, me dumb).

tbh if she is prosecuted then surely in the eyes of the law she is at fault, hence you shoul dhave whatever you want

The 5k is what its scrap value is

Whatever happens, that car ain't going on the road again

Which is a shame as it will be difficult to replace

Its valued at 5k scrap value as it is.

Ive seen another skyline by a chap who use's this forum im just hoping that i get paid out quick enough so i can get my hands on it.
