You can pass someone on the inside as long as you do not pull back into the overtaking lane. I've seen traffic cops on the TV waiting for someone undertaking to actually re-enter the outside lane. They cannot do anything until you have done that.
Simple rule of thumb, if somebody manages to pass you on the inside or undertake you, consider that you may be driving incorrectly, as if there was the room for them to pass you, there was the room for you to have been in that lane anyway!

Highway code (not necessarily law, but a good place to start);
"242: Do not overtake on the left or move to a lane on your left to overtake. In congested conditions, where adjacent lanes of traffic are moving at similar speeds, traffic in left-hand lanes may sometimes be moving faster than traffic to the right. In these conditions you may keep up with the traffic in your lane even if this means passing traffic in the lane to your right. Do not weave in and out of lanes to overtake."

Making better progress in lane 1 and staying in lane 1 IS the OFFICAL way to drive. Why should you NOT drive how the highway code states just cos some halfwit is sitting in lanes 2 or 3 oblivious to anything around them??
If the motorway is empty, I'm in lane 1. If it's busy, invariably I am also in lane 1. Driving how one is taught to drive.
I shall continue to do this. It is 100% correct as I am driving how people SHOULD drive.
