Surely put a sign up at the gate, saying "Danger, work in progress, no liability accepted".....would that cover you? Suspect not, but legal eagles can advise

If so, get one up quick!

What was the alleged defect that the old person tripped on??
If it was less than 25mm then generally there is no actionable defect there.

We see claims of this type all the time from old people, more often than not the claims are turned down as the pensioner has not taken due care and attention.

Unknown. If the person could show due cause for being on the drive, ie. some shrubs over the path were impeding the path of his zimmer then yes it would be your fault. The OAP could be partially sighted and not see the gated entrance to your path or the drive might be the shortest route to your door etc etc. These are the kinds of questions that would be asked by the very nice people that are no-win no-fee solicitors...

You'll probably find that putting "Danger" on the sign is an admission of guilt before you start!

It follows the same thought as "Beware of the dog" signs. Saying "Beware" is admitting your dog is possibly dangerous and leaving you open to prosecution.

Sara,

before said pensioner entered your property, he- she should have caried out a risk assesment..... part of which should have assesed the dangers they could encounter... obviously they didnt do a good risk assesment...

has the defective area been pointerd out to you?? is is a trip hazard??

if not then they can trot....

if you make a drive safe.... and cause an accident , then you are liable

however if you leave as is then your not...

thats why you should never clear snow outside your house... (read up on that one)

see cab but i thinks is a claim blame scam

Your buildings insurance will cover you for public liability normally up to the sum of 10 Million, he does have a right to claim so if he does just forward it to your insurers.

i think its ok, i have spoken to the police and it turns out the old bloke had to walk sideways to reach my door 'cos the car was parked in the way, in doing so he fell off the edge of the drive into my bushes that edge it

it appears that if he saw an obstacle in his way before he had the accident, then he should not have attempted to make the hazadous journey and refused to deliver the pamphlet at all, or left it in another place.

i did say to the police that if he was going to do anything that i had a small dent in the side of the cart that wasnt there before

ts unbelievable that someone can make a claim against someone else on their own property

do you have an area where you can fix a sign to in a prominent position.

quickly make one up saying.

persons entering this private land without the consent of the owner do so at their own risk the owner cannot gurantee safety of person(s) or belongings.

sign it, and get a witnes to sign it and date it last year some time.

make another sign up saying that you forbid unsolicited mail and that will double screw his con tactics as he shouldnt of been delivring the leaflet to you in the first place.

pin it up when he comes back point him at the sign saying can you not read you old git. there are hundreds of people how make a living out of this sort of crap, the witness will probably the mastermind of the whole plot. and him saying he has a witness is all to clear that it is infact acon, so beat them out ther own game.

oh and if he is delivering leaflets for money it is upto his employeers to protect him the same as paperboys ect. even if it is a charity.
