I think that the best you can hope for under the circumstances is that the insurers decide bump for bump. The biker will be claiming you for the damage to his bike and for any clothing that has been damaged, and you will I assume be claiming him for the damage to your car?
Luckily for you, your damage appears fairly minor therefore if the claim is decided bump for bumo then you may opt to repair your car yourself, hence leaving your NCD intact. (assuming you aren't protected)

once away from the scene and he gets talking to his mates the blame will move onto you, as why will he take the blame ???? everyone is OHHH its my fault at the scene but once they have time to rethink the circumstances it all changes !!! get a witness !!! all he has to do is make a drawing of the road and how the accident happened bend the truth a little and its all your fault !!!

I already heard him making his statement to the police saying he was behind the left turning peugeot and not overtaking....
funny how I took the film camera and took some shots of the skid marks and the scrapes the bike took along the tarmac oh and also the final resting place of the bike....
All of it was on the wrong side of the road.
Police didn't want to take details of the marks on the road saying the three witnesses were all the information they needed... without hinting in who's favour that would be.
Although the efficiency of the police and ambulance service and road sweeper were clear to see on the day (all there in five mins from my phone call), my confidence in them (the police) dwindled when trying to sort the HORT 1 (producer) out for the docs I didn't have on me at the time.
Basically I went straight home, got my licence and went back to the "Headquarters" in cheltenham.... reception closed..
note on door said try help point which was a speaker phone on the wall.
Woman within said come back at 8.00 so I went away and went back at 8pm to find a note on the door saying open at 8 am![Roll Eyes (Sarcastic)](images/smilies/rolleyes.gif)
Went back today at 3-4 pm and lo and behold shut again, so back on the speaker phone I was told "We'll send someone down".
The queue grew all taking our turns at the speaker phone, each time being told they will send someone down..
25 ******* minutes I stood there.
good job it wasn't serious !!
this is the HEADQUARTERS of the gloucestershire branch... and there is no one willing or able to do the reception desk.. WTF !
anyway a young police lass walked by for the second time and asked if we were still waiting .... no I'm just stood here in last nights clubbing gear for no reason..![Roll Eyes (Sarcastic)](images/smilies/rolleyes.gif)
She then said she had heard it on her radio that no one was available and we should all come back Monday.... (nice of someone behind the speaker phone to tell us that then!!)
Police force.... sorry "service" 9-5 now is it.

Greenlight said the claim form will be filled out over the phone and would take 20 odd minutes to do, having not got his details to hand and being at work, that wasn't an option so I'm ringing them back tonight after work

its not the police you need to convince on whos fault it is, its the insurance loss adjuster. get as much info for then to make a decision on who is at fault !!!go back to the exact road and park your car up where it was when it was hit and take pictures of it as well to back up your claim !! then all your pictures as well as a extra witness address can be used to help you

Phone call within 5 mins and greenlight say "Highway will not accept calls from brokers about their clients, The clients must ring in person to highway themselves, which wont be until tomorrow now as they are on the out of hours service."

It is alwasy unwise to pull out into a main road when there is a car on your right causing you to be unsighted as in this example, as it is also unwise to overtake as the biker did.
The biker was on the main road though and you were entering it so they may well find that the biker had priority.
I would imagine that he threw up because of the sudden shock of the incident and maybe a clout in his stomach as well. He was certain silly if he was not wearing gloves.
Glad he was not badly hurt and that your car was not seriously damaged. His bike will expensive to repair however, especially if it needs new fairings etc.
