legally if something breaks within the first 6 months its assumed the fault was was there at the point of manufacture and its up to the seller to prove it wasn't. if they can't prove it you are entitled to a replacement foc or a full refund.

i'm no law man though, so check it out yourself! just what i'd read on trading standards/consumer rights web sites. do a quick bit of copy and pasting off the mentioned sites informing him of his correct legal standing and give him an opportunity to put things right. if no joy ring trading standards and or go through the paypal system if that's how you payed. i no ebay/paypal doesn't have a good rep on this sort of thing, but just by starting the paypal process gave a kick up the **** to a pr!ck who i'd been waiting 2 months to post my item, as a couple of days later it turned up.

edited to say dont no if any of the above applies to auctions, like i said i'm no law man

As I recall the Distance Selling Act allows to you to return anything within seven days if you have bought it over the phone or internet.

#32 unless its broken - under the DSR it has to be returned in the same condition you received it, so it wouldnt apply in this case.

But, it can be returned as faulty, which is more awkward if the seller is being a bit of an **** as in this case.

As far as the law is concerned, Ebay 'auctions' are NOT auctions in the same sense as traditional ones ( the difference being that the bidder cant physically inspect the goods before bidding ) - so the returns situation is different.

To get back to what the thing actually is, it's got a probe like the one shown in that PC temperature module that was pictured. Is the Nomad one backlit? If not it's identical to the Maplins one which is under a tenner for the lot.
