I am not paranoid, nor have I said I am paranoid, I asked a question, to which until cw42 started the thread was fine, and had given me more or less the answers I wanted, barring lydia's comments as Lydia had read the thread as it was intended

No. Not even the police can demand that a photograph be destroyed once taken, copy write with photographer.

Not true. it's not illegal only if security guard asks you on behalf of the owners to stop, you were to ignore him and police were called would you be arrested, Then not for taking photos but for some jumped up charge like causing a public nuisance or breach of the peace.
Security guards in malls etc cannot confiscate any equipment, this would be theft.
This is a little know hobby called photography. Google "Street photography".
The taking of candid photographs in public places. Has been going on since photography started.
Anyway the authorities have plenty of CCTV footage of you & kids walking around the street and in the mall anyway this is also done without your consent.

Although if he was truly doing candid street photography why use flash and draw attention to himself?

my kids school plays this year had a new "photo" policy.........they sent a letter to all parents saying "take as many pics/movies as you like, obviously stick to the law (your own use, etc) but other than that crack on"........they then asked anyone who objected to their kids being photoed to let them know - so they could remove them from the school play Just the way it should be.

its his choice to take pictures.... although taking pics of children is just weird(if he was following you arround snapping shots) but one or 2 pics.... you should feel famous

Quite basically, no. You are in a public place (regardless of if its private property such as a shopping mall, if the public are allowed to congreate there then its a public place in the eyes of the law) and as such you have no expectation of privacy. If you have no expectation of privacy, then you can be photographed by anyone who wants to photograph you. Its the principle that the papparazi operate (or exploit, depending on your viewpoint) on a daily basis.

This is the interesting part, as he was walking round openly doing it, then he was within the law. If he was specifically targetting you, in a manner which was calculated to evade your detection of his actions, then he would be breaking the law. Daft, but thems the rules.

The only thing you could do would be to ask for a copy. Under the data protection act, you are legally allowed a copy of any media (video, audio, still photograph) which has you on it. You usually have to hand over a tenner as an administration charge, but thats with big companies, I'm not sure if individuals can justify this.

a new centres opened near me called the frenchgate inter change. Ive been in there for xmas shopping recently and a lot of people are taking photos of shops. Not seen a problem with it really.

To exploit your image for personal gain means you may be entitled to a cut. Where this startsin is open to negotiation [you in close up versus wide crowd shot...]. Cue common sense.

In the TV world we have to issue a participants release form - this would be for people actively taking part or 'being directed' it is not relevant to each reveler in Trafalgar square on new years' eve for e.g.

If you end up identifiable on that shops 2007 catalogue cover ask for a few quid modelling fee, if not rest easy, and dont take it personally
