Not that I've ever had a fine or had to deal with something like this - but surely they send them registered post/recorded delivery? If not that, surely they must have attempted to call you to court before sending the police around with a warrant (which would seem pretty last ditch to me).
If you've never signed for reciept for any fine demand or court summons then isn't that proof? Or at least lack of proof that you had anything to do with the vehicle?

Have you had any other items about this car sent to you before – speeding tickets etc..?
For a warrant to be issued, it means that you (or whoever was committing the offence) has not appeared at court when previously asked to do so. The court case will be about the original offence, which the court needs to satisfy itself that it was you that has committed. Therefore they will need proof (eg photos, witness statements etc) otherwise they cannot find you guilty. Speak to the duty solicitor and they can do the running around for you at court – they get paid enough.
When you sold the car, did you send off the slip to DVLA to say you are no longer the keeper..?

That’s probably it then – the car is still registered in your name for some reason.
Prasius is right as well – a warrant is normally the last in a line of posted court dates etc – you’re certain you have had nothing sent….
Have they said what the original offence is for – it should say on the warrant

Are you going to be joining all them shell-suited pikey scummers hanging out on the front steps having a *** then
I wish them railings weren't there, otherwise a carefully driven artic could wipe Macc's burglary problems out at a stroke![Lol1](images/smilies/lol1.gif)
What the coppers told you is bollox BTW, the onus is not on you to prove you didn't own the car, It's up to the prosecution to prove that you did
Despite David Blindcnut's best efforts 'Innocent until proven guilty' is still the basic tenet of law in the UK
Unless you get caught by a Scamera obviously

2 things, if you were down as the owner then surely you would have recieved tax renewal notices etc.
2nd thing, the name on the log book is not neccessarily the owner. I am sure it says that on logbooks.

The way it could happen is that someone else acquires the vehicle and changes the address to a fictitious one. Therefore any fines, court summons etc. will go to this made up address. Eventually a warrant is issued to the registered keeper – which on paper is still Stressymare. This then gets passed to the police who check to address and find it to be false. They will then do checks on the name and establish the correct address. Turn up and execute the warrant.

Sounds like an inputting error at DVLA if anything, seems to be happening alot recently.
Best thing you can do is contact the courts etc like everyone has said.
But for them to say you have to prove you never owned the car, thats wrong, the law states "Innocent until proven guilty", like its been said, THEY have to prove YOU owned the car first, not the other way round.
I've been through this alot when someone I knew (I wasn't friends with this person, but they live close to me and know my name etc) was buying cars at auction in my name and running them with no tax or insurance etc, I've never bought a car at auction ever. After talking to the Police and frankly getting nowhere (They said I had to go this guys house and get a picture of him driving the cars!) I contacted the auctions around West Yorkshire and put a block on my name and address. Its not happened since to me but I bet it happens more than we know.

That went out a long time ago. In this country you are guilty until proven innocent these days.

Yeah, unfortunately I have to agree with you. I was trying to kid myself but it does say it in the law books still (assumption) and I'm sure a good solicitor could use the phrase in your favour, when their on your side of course. lol

I as once phoned by my Mum to tell me that there was a police van there to arrest me for failure to attend court. I never received a summons or anything , it was for forgetting to produce my documents. Had to go to court next day, produced my documents and they let me go.
