need to speek to a police officer urgently.
My best mate purchased a car from a showroom, back in july 06, it was a saxo. She has had an accident and wrote the car off 2 weeks ago.
It was her fault, the insurance has asked for all her documents, when she has checked they have given her an MOT for another car.
They have told her because it had more than 6 months on the ticket when she bought the car they wouldn't have put a 12 month ticket on it.
If this is so she has no Mot how does she stand.
She is insured and taxed, it doesn't look too good does it.

If she has in her possession an MOT for another car, doesn't that point rather strongly to the fact the dealer gave her the wrong certificate? If a car with the same reg no. has been sold by that dealer (or maybe it's still on their forecourt) then it's clearly their mistake.

Presuming they did complete an mot for the car and it just got lost or given to someone else you should be able to get a duplicate and the number to call should be on any recent mot. Just a thought

Only if something went wrong with the car that then caused it to crash can they not pay out, even then this would have to be something that would have been picked up during the MOT.
What it will allow them to do is offer a lower settlement for the car, as a car with no ticket is obviously worth less than one with.....

you can check online for tthe recent mot record for the car v easy to do, if its mot'd it will show, will also show what failed on or advisorys
once you have the mot station details you can apply to them for a duplicate

was she told what MoT was given with the car? if she was the sale of goods act (1974 i think) specifies the sale must be as described. if they said x months MoT and this would have covered her for the time of the accident then whilst she should put her hands up and say she did not check the MoT certificate is hardly grossly negligent. who on this forum can say they checked their last MoT certificate top to bottom, date, mileage, signature, date of issue etc. i would contact trading standards or CAB and quote the sale of goods act to them, then the dealer.

She was given a MOT with the car, the onus would have been on her to ensure the paperwork was correct at the time of purchase. Equally the garage could say they gave her the correct MOT at the time and claim she has no recourse for action against them. The garage does not have to prove that they are in the right in this case. It is a sad state of affairs admittedly but shows you have to go through everything with a comb.
I appreciate that but how can the dealer explain how she came to possess an MoT certificate for a vehicle they sold to someone else? Trading Standards would be interested in this I am sure, what happened to the owner of the other car, do they have her (possibly) valid MoT certificate? Surely worth checking out? Under the Sales of Goods Act they have fallen foul of their own legislation they ahve to adhere to and within the realms of good faith I don't think the owner can be held at fault for this oversight. I accept the dealer will be difficult but worth a bash me thinks!

Fair point, the garage would have to explain this as they sold the other car. Hopefully it will all come out in the wash.

With the new style mot ,any mot station( that has the computerised system ) can issue a duplicate for it as all the details of the test are stored with VOSA .
