Yes, unless there is more than one person inside

Even open spaces can be declared 'smoke free' areas .....

Yes convertibles ARE exempt

Exemptions from said Act

(5) For the purpose of making provision for those participating as performers in a performance, or in a performance of a specified description, not to be
prevented from smoking if the artistic integrity of the performance makes it appropriate for them to smoke

I thought they were going to bring in a law banning people from smoking whilst driving anyway so therefore company or private car, you wont be able to smoke either way

Here are the real rules:-

Will the regulations include all company vehicles?
The new law will not apply to vehicles that are used primarily for private rather than work purposes.

Where a vehicle is used for work by more than one person, regardless of whether they are in the vehicle at the same time, it will be required to be smokefree at all times. This protects all who use the vehicle from harmful secondhand smoke, regardless of when they use the vehicle.

Smoking will be permitted in vehicles that are for the sole use of the driver and are not used as a workplace by anyone else, either as a driver or passenger.

Therefore if you have a company car, and you carry a passenger once or the car is driven by someone else, the car has to be non-smoking at all times......................

Like I said... this is pretty much how my company is applying the rules

Mine too. The argument is that even though 99% of the time, you are the only person in the car, if you take a colleague somewhere, it is then a shared workplace.

Bloody stupid in my opinion and my sticker is going up in a door pocket or inside the ashtray.

Even more difficult to enforce if the stickers were pictures of naked ladies
