Oh this gets better!

I turned up at Rochford Tyres yesterday after an agonizing trip up due to injury and once they realised who I was and why I was there Mike appeared. Things were perfectly polite, they at least appeared to admit that there was a problem and we went from there. Being a nice guy despite everything I said as per the emails that I was perfectly prepared to get a refund for just the cost of the faulty set of wheels and tyres and pay the difference on another set. I had wanted the Kei puls rims but the lead time was huge and the borrowed set I went up I had no intention of keeping on. They had a set of Kato Enzan wheels there in 18's with great brake clearance like the Wolfraces so I went with those. £970 so paid the £260 difference. Car was as smooth as silk now so I left a happy bunny. I never saw the 'MD', but some old bloke was nosying the front of the car as if he was trying to see some glaring fault with it while I was there.

THEN, this turned up in my mailbox today:

"Nick,

Regarding the tyres that you have returned to us. Our Managing Director of the company has inspected all of the tyres that you have sent back and the result is that the tracking or geometry of your car is not correct. This has resulted in the tyres wearing unevenly. This also explains why the wheels and tyres wobble on various cars as the tyres are not square.

Because of the result of this your card has been charged the cost of the tyres which is £335. We will send these tyres back to you by courier. We can have the tyres independently checked by Avon if you wish before sending them back to you. Avon will send us a copy of the report which we can forward onto yourself.

We would advise that you have your 4 wheel geometry and tracking checked before your new tyres wear.

You can take this matter further if you wish. If you wish to contact us please send a letter addressed for the Managing Director of Rochford Tyres.

Just for your thoughts, I have included my reply:

"See you guys in court then. Which part of I had the car fully balanced and 4 WHEEL ALIGNED was not understood in previous emails. I even sent you a copy of the full alignment receipt for my car that I had carried out on May 12th!!!!!! I never over pressurised then or anything like that, never do track days etc and just drive the car every so often.



I had held this in reserve but it now appears that I will have to use it. I have a written statement from Len Carlyon of Subaru4you explaining exactly what he found along with his wheel experts, the fact that I had mentioned this problem to him ever since I got the wheels, I know the manager of the Local Merityre well that carried out the full alignment almost as soon as I got the wheels and I have been using them for all of my imprezas for 6 years now and also this last bit which you should take note of.

I work for the countries number 1 legal software house, providing software and networks to UK law firms and have made a lot of friends in legal circles. A good friend is Mr Kieran O’Rourke, partner at Howe & Co Solicitors in London. After being told by yourselves that nothing was wrong, despite knowing this to not be the case I contacted him stating all the facts both over the phone and by email. He has all the details and has said in no uncertain terms that you haven’t got a leg to stand on. He will come after you guys for selling faulty goods, all the costs I incurred trying to get to the bottom of the problem, being lied to about the wheels being tested by yourselves when my friend that came up last Saturday and saw the SEALED boxes sitting there unopened, the expense of driving up there to sort this out in person along with a number of other things. This will be messy and expensive, but not for me.

I would suggest strongly that you do not take any money without my permission and let this drop. I am not some little kid that is going to roll over and play dead while you try to con me yet again. Being kind I paid the difference for a set of wheels that actually work perfectly, unlike the old set that gave problems from the second they were fitted. I will come at you with everything that I have and I have an awful lot of backing stating that you are wrong.

Cancel your ludicrous, unjust and illegal charge and that will be the end of it. I have already called ALL of my card providers to make sure that a dispute will be logged instantly should a payment request be made by yourselves other than the £260 I paid yesterday.

I really don't want the hassle but should I go at them with everything I have if they don't back down? I have cut a couple of bits of the email out and some of the spelling errors that were rage-induced

Kato Enzans are the wheels my mate is having all the problems with the paint peeling off.He told me Rochford are sending him a replacement set this week so it will be interesting to see if they are better than the last set which were total junk.

i don't think that they can charge the card for the tyres as you never authorised it.

i think you have been more than fair and would persue it if it comes to it. I don't think that they realise jsut how many people have internet access and do research on the companies that they are looking to buy products from.

If they had an ounce of sense they would come to the conclusion that chances are it's going to cost them an awful lot more in lost business alone without the money that they have to pay you for expenses, legal costs etc when / if the courts deceide in your favour.

Nick,

Sorry your still having problems....
But you've seen teh company first hand now and you know their a two bit company that relies on the glamourous image of the net to sell their products.
They are trying their luck hoping that you'll run scared.
I would like to know how they plant to have them tested and can verify that they were the ones from your car, given that we changed one when i was there on the saturday!
Go for it, i can't see you have anything to loose.

cancel the card asap, Whichever card it is its an unauthorised transaction, so if they take it you should be able to get it back

Spot on - taking money by using your card details without explicit authorisation is in effect obtaining money by deception - that's theft in plain English. If they haven't already done so, you should intstruct them to refund it immediately before you inform your card provider, trading standards and the police.

Feel for you matey - I've had some pretty shabby treatment from companies in the past and even ended up using the small claims court on one very well-known company. They caved in 2 days before the hearing - stick to your guns

The name rang a bell, but you know what it's like when you are miles away from home, not on your own turf, with no one for a second opinion about. I asked Mike specifically if they had any problems with those. 'None whatsoever' was what I got back. Hopefully they will be fine. I was shocked when I saw what colour 'Hyper Black' was. I asked them to double check as it's basically blinged smoky silver. Not my ideal choice but the main thing is she goes properly now:

My mate got an email today saying that the Kato Enzan wheels they were going to send as replacements were silver instead of the hyper black and would these do as the hyper blacks were out of stock.He told them no way and wanted a refund so they have offered him a choice of any another wheel - he is going for black Team Dynamics 1.2s instead.

Called the sales dept asked for some dodgy wolfrace wheels to which the guy replied 'are they a new model out' Priceless. Which ever card ye paid with tell them that if this company try to take more money off your card they are to refuse as you have not authorised it, you have to give them the 3 digit security code off the back for a 'customer not present' transaction.

Well, those conmen have taken the money, from my debit card! They used the details from when I placed the original order back at the end of April. I had no idea that I had done it on debit, which is unlike me anyway for large purchases. I had been checking with my CC companies, not my bank account.....

I am on the phone to Natwest at the moment, I am now a hair away from going to my limit on my account. Natwest can't believe this either and I am being put across to their fraud team to see if they can do anything. Spoken to my solicitor who is loving this and is putting a letter together on Monday once he gets back in to the country. Lol I want to kill atm .

Sadly Max was put down late last year from advanced bone cancer but we have a new rottie called Titan. He is only 7 months old and is already the size that Max was!

Fraud department have stated that the money was taken without my consent/approval and was manually entered by them. They state that this is fraud and have made me cut up my my debit card, declare it as details stolen, have put paperwork together for me to sign/return and have issued an official chargeback against them for the money. The central fraud team are literally just down the road from me in Farnborough, nice spot of luck .

Not sure if I want the hassle but I am sorely tempted to go for the jugular tbh.

Very interesting thread.... there are plenty of cowboys out there that you have discovered first hand....

I salute your restrain in that you haven't gone down there and smashed them in.

As the bank are now on it, I am sure that they will be happy to go after Rochford tyres..... keep us updated!

Thing is....... this is exactly what these cowboys rely on,people will just roll over and accept being treated very shoddily,not sure if its a british thing or what,but seems to happen all the time,it needs guys like your self who have been put into situations like this to firmly redress the balance and show these jerks that they cannot get away with things like this....... refund and compo that hits them hard in the pocket might deter them from doing it to someone else....... trading standards might well be interested in their fraudulent behaviour also

I am watching this with interest, was going to use them for some new wheels myself.

As they have now charged your card for those tyres, chances are they are going to be delivered to you as well. When they attempt the delivery I would decline the delivery because you never ordered them, and they should then find their way back to Rochford at their expense.

I have instructed both work and home to refuse to accept ANY tyres being delivered, luckily I thought about that one.

Just spent a while reading this thread with interest seeing as I live not 5-10 mins away from them.
Got to admit as a rule I won't use them as i've not heard good things in the past and they don't run what I would call a trustworthy business, seems after this debacle my thoughts were justified .
Always sad to hear people getting sh@fted by people like this and I hope you get a good result at the end of this.
What they have done is def. fraud and they can in no shape or form take money from you without your consent so I hope they get the book at em !.
Need to spread the word about this crap firm, did anyone realise they also tout their goods on Ebay as well ?.
