Alterations like settling 50/50 for an easy closure.

I would declare all accidents to the insurance to avoid invalidating your policy.........its all on record and the insurance company probably know there is a claim in your name before you answer the question.

As for renewal, the insurance company agreed to insure me at the new rate (£500 MORE )but then to give me a FULL refund of the difference once it was settled. I said no as it wasn't my fault. Strangely enough it was settled as a no fault claim about 45 minutes later.

Totally his fault whether you were speeding or not.

Think about it.

He says "You hit me because you were speeding."

You reply "So you pulled out because you did not see me and if you did not see me it does not matter one jot whether I was doing 5 or 50 because you were not paying attention." End of.

I had a similar accident in January. Woman pulled out in front of me, I hit her from behind and after taking photos of the junction from her point of view (clearly showing 1/3rd of a mile visability) and following Andy the claims dude's advice, she (or the insurance company) eventually admitted liability. Still waiting for the payout to be settled, though

if he did not have right of way ie he was pulling out of a side road to cross 2 lanes of oncoming traffic he is to blaime just because the car in the inside lane lets him out doesnt mean the traffic in the outside lane is gonna stop there for he should of pulled out and been looking for traffic in the outside lane to make sure they stopped but if u aint seen him u cant stop lol and by the sounds of things he's just pulled accross the road with out lookin for other road users in cases like this its always best to get the police involved they normally can sort it out fast and if his insurance finds out he's been charged on a motoring offence because of the accident they would just pay out

from what I have heard it sounds like his fault, but I can see the insurance going with a 50/50.

I sympathise with you mate, I was involved in an accident about a year ago.

It was on a duel carrage way, a guy crashed all by him self into the barriers in the oncoming lane. I hit all the debris including some rather large bits of car at around 70 mph. It caused around £1000 worth of damage.
Anyway to cut a long story short, my excess was £500.
I thought id get my money back in a few weeks.
After months and months of phone calls it ended up going to court.Thank god the police attended the accident, because without the police report I would not have got a penny!!! It took 10 months to get my money back even with a police report.

It must have been the most simplist accident ever yet it took an age , I had almost given up at one point . the car never seemed to drive properly again! so i got rid. and bought my first Subaru.

Don't get me going on insrance companys, i had a moorbike crash which blatantly wasn't my fault, but because just one of my witness's put something in his statement that didn't ring true, i ended up havin to take 50/50 on the advice of my soliciter, 18 months later i've still not recived a penny an i'm left with a trashed nearly new CBR600rr which i had to sell for peanuts, god damn hate insurance companies, quite happy to your cash off you but it's like getting blood out of a stone to get ny back.
