I'm sure a well written legal disclaimer could sort this: Signed and acknowledged by the customer that the garage has no liability once the car has been given back to the customer, who which acknowledges that the vehicle is illegal and unsafe to use from that point onwards and on no circumstances should it be used or parked on the public highway.

surely every car that came into the garage would need to be given a full mot inspection free of charge then?
You could also state that you checked that (offending) part before you came in and blame the garage for trying to get extra work/money from you.
I'd stop using garages if that law came in.
What would happen if your putting your car in to have the exhaust de-catted,would the garage then have to change it back after as it wouldnt pass the emissions?

Another thing...

An MOT only states the car is roadworthy ON THE DAY it was tested. Technically, the car can be considered unroadworthy the very next day (although, if it was, it would look bad on the MOT tester, unless it was a trivial fault).

Which is why the owner of the car has a duty of care to be aware of the car's condition.

I do believe this would solve the amount of non-roadlegel cars on the road. but on the other hand, you could find garages are just full with ownes leaving there cars to rott, which in turn poses a problem for garages.

Solution....

this will drive the car repair business further underground... IMHO and then what will happen.

be funny hanging round the reception areas on a saturday afternoon though

I had this issue (I think) with my Pug a couple of years ago. I took it for a service and my brakes were shot. The garage wanted £300 to fix them, but I was unhappy with the price.

To be fair, the brakes were really really bad. They warned me of this, very clearly, and wrote it down on a sheet of paper they printed and handed over to me before I left.

I think that covered them.

Mind you I did not save any money in the end anyway Although I did get better brakes for my £300

I take car in for MAF, garage looks at brakes and says they're past it you're not getting car back it's unsafe.

I know brakes were done last week and are fine so it's my word against his - do I have to pay him to do nothing to my car before getting my keys back!? This policy is wide open to vulnerable customers and unscrupulous mechanics!!!

My sister took her car to KwikFit for their free brake test. She phoned me and said they wouldn't let her take the car away unless she had new brakes fitted as they needed replacing.

I went down there and told them I was taking the car whether they were going to let me or not.

Long story short,the police were called who told the manager he couldn't withhold the keys and stop us from taking the car even if the brakes were worn out

I'll stand corrected but as far as I remember that is what has been the rule for a HGV etc for many years. If when it was having its annual test it had a GV9 (illegal/dangerous condition) failure, then only a small unofficial repair maybe allowed on site that day or recovery of the vehicle was the order.

can't see it happening as it can't be enforced if i turned up to the garage with car having been in for a service or something miner and they said it needed new discs etc and wouldn't give the car back till they fixed it.
Think i'd be on the phone for a few friends or return with a bat to get keys back and i think garage owners would know that so can't be enforced by the garage or even fair on the garage to be expect to deal with that.
But like all new laws etc made up by someone sat in an office that know f**k all about the real world

If the car is not road-worthy and it is something that makes it dangerous, ie bald tyres, broken suspension, seriously worn brake components etc, I wouldn't have an issue, firstly because I know I wouldn't let my car get in that state and secondly for those who do, it may get some death traps off the road.

I'd be more interested in how you as a garage owners feels. Suddenly someone brings a car in for a £10 oil and filter change, would you not be obliged to give the car a free safety check before you could let it go - how would you as a garage owner manage you overheads as you could not charge for work that is not requested. Does this mean your hourly rates would have to go up to cover the additional costs of these checks.

I was informed by a test station that if you get it re-tested in the month grace period and it fails, it invalidates the old MOT as the car has been proven un-roadworthy.
