lol some very interesting replies, and I agree it does look rather automated. I shall keep the thread up to date with any replies I receive. And in the light of the other cases, which I am aware of, maybe I should put the domain on Tazbar and let Ebay bid on it :lol

do you lot think there is no copyright law here? Whether or not your domain infringes is another matter (especially concerning "fair use"). I'm not a solicitor. However copyright owners do have the right to send cease and desist letters (which is basically what this is). It is up to you to prove you are not infringing. Do you want to fight it?

I think its a trademark issue rather than copyright, as I am not "copying" any format or theme or other such visual representations.

I think there is a minimal case to be heard, but I think this particular case is some what weak, and worsened by the fact they would rather some of the discussions about Ebay and their lack of interest in protecting traders from scammers.

I'm no expert in this field, but from what I have seen in the past.. probably one of the worse things you could do at the moment is offer it up for sale, or ask them to buy it at a ludicrous price... especially if you are going to cite 'fair-use'.

Speaking of which I don't think we have quite the same protections here in the UK regarding 'fair-use' as our trans-Atlantic cousins do..

I think practically EVERY time I have seen this the 'big man' has always won... except for the case of easyart.co.uk who IIRC took on Stelios and won.. pretty much because 'Easy'.. is a generic word, and they could prove they were not passing off in any way.

lol its all good, I cant actually sell it anyway, as its still in the contract period, so would only be a mess about.
I see the point you make though, and at the end of the day, it was never bought in spite of Ebay. So my only issue with it all, is the tone taken, and the threatening "advice" they have offered.

But eBay is a registered trade mark, and you are using it. They have to protect their name. If you set up a site called Rolls Royce you would eventually get the same sort of letter.
I work for a large multinational with a very famous name, we will pursue any one using our brand name or trade mark. I dont think we have lost one case yet. So please be careful.

have these large companies got nothing better to do than bully small or one man band companies.

I can see it now! some jumped up s**t sat in his office twiddling his thumbs sifting through the web searching for copyright issues and whom they can pick a fight with.

Personally i'd tell them to 'blow me' and come and get me.

Yup I do see that side of it, and totally understand the stance on it. However I am in no way trying to mislead anyone to believe they are using the original site.

Bit like the holiday company Thomson, if I were to buy Thompson and make it a holiday site, I would expect to be shut down QUICK ! lol

I struggle to really see where their problem is unless they don't want the 'bad' press so to speak, or they are obsessed with having all the ebay relate domain names in existance. lol.

I have actually suggested in my reply that they should maybe consider registering all the domains or requesting Nominet disallow the registration of such domains.

Although Thompson.co.uk is about food for live-stock. Maybe you could start selling holidays to farm animals

Strange coincidence... I work for a company that offers a service i.e domain name disputes.

I discussed the domain name ebay-scammers.com and technically the domain infringes on eBay's copyright and trademarks etc.

If the domain did not have the word ebay in there you could have told them to f-off. Get the domain changed or offer to sell it to them They can't sue you for discussing eBay, thats your given right but intellectual property and trademark infringements are all the rage these days (my employer makes a heft profit from helping big brands file cases against domain squatters and people like yourself who happen to use a word that is part of some companies trademark).
