I played on the lack of personal safety I felt surrounded by out of control drunks and the fact that I paid extra for a service that wasn't delivered.
Add that to the fact I'm very, very good at complaining and you get a refund in somewhat less than the frankly pathetic 20 days Virgin were first predicting a response in.

Extra service that wasnt delivered?
You cant say 'premium economy' without using the word 'economy' - thats your first clue- business class it is not.
You: got the extra legroom- which is the main selling point of the PE cabin/seat.
-got a smaller cabin (on the upper deck too..)
- got preflight drinks
- got premium economy check in desks.
- got in seat power for your laptop
- got different menu to economy
- also (somehow) managed to blag lounge access on a PE ticket (which you definitely didnt pay for as you cant buy it).
So what exactly did you not get that you paid for? It doesnt promise a quiet isolated experience free from other passengers. Its a slightly more confortable seat with a few other enhancements- nothing more.
Some pax are noisy- deal with it by putting your earplugs in (and they are provided in the PE amenity kit so no excuses..)
I fly lots and have to put up with noisy *******s from time to time. Even in the front cabins, you still get noise from behind coming through sometimes- and baby screaming also. You also still get noisy gits in premium cabins- Not a lot you can really do about it really unless you own a learjet.
I really can't see any basis for your complaint, a demand for a refund, and certainly not accusing them of being unsafe because a couple of people had had too much to drink (and that is only your personal opinion...).

I only ask as there is, quite reasonably I feel, a certain amount of doubt about your story. I'm meeting Virgin tomorrow morning and during coffee thought I'd ask them about the rowdy passengers on your flight.

As the per the title, is it possible or are they protected from small claims court action following their inability to provide services I paid for?
Not the actual flight itself but lounge, seat upgrade and general crap service during the flight.
A bit of background to let me blow off some steam.
Virgin Atlantic (wakners) 12 hour direct flight, paid extra for better seats to find I'm given some in an area where the sort of vile low lives I expect only to find on charter flights to Iberia like to congregate while drinking themselves even more stupid on 'free' booze. Overall I'd have been better off sat next to some screaming brat in terms of the work I managed to get done.
Why do they let these sort of people out of cattle class???
Obviously talking to the plebs about their behaviour bore no fruit other than a token attempt at acting like human beings for 5 minutes. They should have air marshalls to taser these dongrels IMO.
I'm starting to feel better already typing this although not as good as if I'd chinned the ugliest looking member of the epsilons.

Sue them, er, no. Get 'compensation' from Virgin for an unpleasant flight, quite possibly, Branson et al take customer service very seriously. I hope your letter of complaint was more constructively worded than:
"Dear Richard,
Your P.E. customer base are all chavs and scumbags. Please exterminate them immediately" Oh, and can I have my money back please?

Your feelings of doubt are of course an issue for yourself much as similar sentiment expressed by others on different threads about my good self.
To be honest I didn't give 2 hoots about the other passengers from a safety point of view, I just wanted my money back as 'premium' economy didn't offer any sort of 'premium' IMO. The safety concerns are just a good button to press to get the desired result.
Overall I feel the service I received was worth exactly what was paid for originally ie cattle class.
Lounge access was achieved by chatting up the customer services desk tart at the airport and flashing my BA Gold Executive Club card.
I was really hoping 'Flight Man' was a Virgin employee so he could offer to service me further with another grovelling apology for their poor service.

For those of you that were wondering, I did meet Virgin today and suprisingly they confirmed Nacro's story, and have issued a company wide bulletin.
Yep, Nacro's been banned. Those of us flying Virgin in the near future can sleep soundly in our beds.
