Do what I did a long time ago.
Tell them your car was advertised for sale in a Newsagent's window and someone came round to test drive your car. You accompanied him on a test drive. He drove.
The prospective buyer didn't want to buy the car. Of course you can't give them his name as you don't have it. You've not seen him since.
I received a letter back asking again. I replied, telling them I wasn't willing to take the blame for someone else's driving just to satisfy their statistics. The next letter I received told me they wouldn't be pursuing the matter further.
This was about 20 years ago but i'd still give it a try.

Someone I know* Did exactly the same thing a few years ago, he* thought he was being so original as well.

A mate of mine sold his car via autotrader, and a week later got a NIP / section174 as the car had gone past a scammervan. The date of the incident was 3 days before he sold the car and he was going to own up to it until I advised him. Not being the most articulate person he asked me to write a letter to them. He included his receipt for advertising the car in autotrader and a photocopy of the V5 as signed by the new owner which all proved he was actually advertising the car and did indeed sell it. But on that particular day he didn't recall who test drove the car. He got a letter back saying "no further action" and I got a slap up meal and booze as a thankyou!

Ooo I had one of them many years ago.

Apparently a Ford probe with my reg no was seen in Trafford road (Manchester) running a red light at 2:00am and had a illegally spaced number plate.

Well, it must have had the wrong letters too, as my car was a Escort and I was at home in my bed 100 miles away. I never had a reply from the accompanying letter explaining that.

Perjury aint worth it - you do time for that, seen ithappen. If you know deep down you had a mad moment just take it like a man.

Is there not an option here to take the 6 points for failing to disclose? Dangerous driving may be a harsher penalty?

Think the 14day rule is for a NIP for an automated scamera fine. This one is more serious and may have been spotted by an officer of ze leaure - ze officers have 6 months I think..?

Write NOTHING at this stage.

Yeah am gonna fill it in. Wasn't driving like a **** the road they mention i am only on for 0.4 mile each way, its terrace houses with motors parked both sides and up hill on the way there, and its coming out of town so usually busy so you cant do much other than follow the traffic which is why i'm

No, aint gonna lie, nothing to lie about. Never had a 'moment' but am totally by the whole thing to be honest

Am gonna phone them in the morning see if i can find anything out. The thing that really grates me is that i've been driving HGV class 1`for the last 15 years and seen all sorts on the roads and been in all sorts of situations, i consider myself a good curtious driver and am very vigilant, i have only 3 points for speed but now i have some dick trying to put a very serious offence on my license which could effect my employment status, if i had been in such a serious situation i am 100% sure i would of been aware, f'ing proffesional driver for gods sake, i know we are all prone to a laps in consentration but...........

Seems weird having that letter, if you didn't have a mad moment and never noticed a copper on that road!

Out of interest - what is the punishment for not furnishing this information?

Read up on the 14 day rule. It applies to most motoring offences in a situation where you have been observed by an officer but not stopped at the time. It's supposed to stop situations like this.

From memory thats an absolute offense and it carries 3 points and an £80, correct me if Im wrong.

I think they upped the failing to disclose to 6 points as taking 3 points for failing to cough was better than a potential ban if your scamera recorded speed was high etc. D

Relieved to hear you are not going to lie in any way. That would really drop you in it.

I would be tempted to go to the issuing police station and ask them what they mean by it before doing anything else.

OK, sorted i think Rang them up this morning (didnt think they warrented 2 gal of V-Power for a visit) and spoke to a rather snotty woman, who after going on auto shpeel managed to inform that:


a. This is 'not' a NIP and can be sent to anyone any time!
b. That i had been reported by a member of the pubic for, 'overtaking in the face of oncoming traffic causing them to swerve out of the way'!
c. They do not intend to prosicute. (No evidence obviously)


I still have no reccollection what went on I suppose this is is just a 'warning' type letter to let me know, that they know, so to speak

I shall fill in their form and return it, in about 20 days time

Anyhow bottom line is, i aint getting nicked

I got one of them last year. Yes, I had been being a naughty boy. Not wreckless mind. Just taking the **** a bit.

Filled it in, sent it back. Got a letter a week later saying something like "we have decided not to prosecute" I wonder if the previous 10 years of incident free motoring swayed it.

Well that and the complete lack of evidence.

Weight off the old noggin I can tell yee.
