You have got the right advice from the best man. Best pay up and learn the lesson. Driving without insurance, or permitting it is a very foolish thing as you doubtless realise now.

Surely there is a way to circummvent this. You were selling the car privately, person visited you to view / test drive the car. You checked his policy which was valid. you allowed him to drive.

You had no valid reason to take a note of his name or address as he was unhappy with how the car drove and he walked away from it.

There is the moral aspect to fabricating a story which I would not advocate in any way, but surely this would be a valid explanation???

Nope your responsibility to check for insurance and to prove it. Otherwise this defence could be used all the time
Anyone else let someone they dont know,havent got their details or cant be traced drive their car??

I personally have done this (not lied to get off the charge). Turned up to buy a car showed the seller my insurance policy and have never had them take a copy for their records. I have never had a private seller ever try to phone the insurance company to ensure the policy was valid, or ask me for proof of ID to ensure the policy related to me.

My understanding from the start of the thread is the the car owner was in the passenger seat, just as you would be when letting someone test drive the car.

the law sucks if you get points for letting someone use your car without insurance!

A friend i work with recently got pinged for a small speed indiscretion...

Usual bumf through the post...

Plead guilty take the points & the fine, or pay £70! for a speed awareness course.....

Speed awareness course was his option......lol

Reply back.... Only open to UK licence holders..

He,s Latvian .. btw

So my friend, opts for the fine, (no points, as he's not a uk licence holder, or an eu member.)

Now they wont accept that he can only get a fine, and want him to get a UK licence so they can put 3 points on it...

My friend is a bit miffed, and is now wondering what happens if they force him down this route?, he,s worried that they will remove his latvian licence, meaning he will have to reapply for a licence/ test on his return home

Why cant they just accept his fine and done with... talk about jobsworths

Usually ou can only drive on a foreign licence in the UK for 12 months. I'd guess they'd wait until his 12 months have elapsed and give him the three points when he is required to apply for a UK license.

I'll ask one of the traffic cops for clarification on Tuesday when I'm out with them.

Meanwhile back at BandCamp there have been 409 assaults, 4 murders, 6 rapes, 763 thefts, ( I was going to say Burgularries but cant spell it).....erm 23 sheep thefts, one sexual assault on a dog, and one copper caught with a dress on......the Police are following leads on all cases, except the Super with the dress on, who is now climbing Mt Snowdon with a hip flask.

PS. The dog doesnt want to press charges.
