Don't accuse me of knowing how the Police think!
As far as I know zey are only obeying ze orders..

The thing is, MOT issues won't be counted as criminal, in other words, it's a fine but no endorsement. Basically, if it needs a cat for an MOT emission test it should have a cat. As it's black or white, there's no arguing with that one!
Noise is something totally different. There's something called amplitude, which apparently isn't the same as volume, which explains why some noises get on your nerves, and others are ok. I used to fly light aircraft, and was aware of grief from residents who live near airfields. They'll run a petrol mower all day, oblivious to the effect on their immediate neighbours, but complain bitterly about a tiny plane a mile away.

The whole fixed penalty system relies on the vast majority just holding up their hands and paying up.

If the majority of people challenged fixed penalty notices the whole system would crumble.

By law, the outdoor products that my company makes, must comply with a decibel level for outdoor use of less than 96db.

Are the authorities trying to tell me that my car should be running quieter than a 200W electric grass trimmer...........

The law is clear that a car exhaust cannot be modified such that it makes more noise than when 'manufactured' (Homologated) (section59 of the construction and use act) so they only need to compare an offenders car with a stock one of the same flavour using the same test, then its down to casting reasonable doubt, Northern (Scottish cunstabulary for the more discerning reader) have been at it for yonks (with dubious practices) as witnessed by the PPP driver done where Subaru UK/Prodrive subsequantly had to both change his exhaust and how they engineered the PPP kit.

That law was written so that people couldn't chop boxes off existing systems or gut back boxes.

An argument goes that if you install a complete system that is CE marked and for road use, then you haven't modified the exhaust. You've replaced an exhaust, which is different. Of course, you are not to remove polution control equipment. So a de-cat is a no-no.

You don't have much to worry about YET, but the equipment exists. I went to a seminar at Bristol University where Environment Technology Ltd. demonstrated drive by testing to a gathering of county councillors. I blagged the gig, as I had no right to be there strictly speaking, I just heard it was on and went! I figured a word from somebody whose job it was to fix dodgy cars might be useful, as they never talk to anybody from the motor trade. They were amazed when I got up and spouted off!
The kit really works, using spectroscopy, amazing stuff, but very expensive. The big idea was that they snap any car that goes over the limit, then post you a "warning".
I can't see too many councils taking it up on cost grounds, never mind accusations of "Big Brother"

Cheers Alan for the response. My scoob became a lot louder when I went full decat. I got stopped by the coppers who said the car was too loud and that there is a chance I could get done for under ASBO rules i.e. being anti-social to the general public. The question is can the police enforce you to undertake an MOT test even if you already have a valid MOT if they suspect that the exahust system may not pass the emission tests?
