What everyone seems to be forgetting is that this is Africa we are talking about. If you are very lucky you may be able to find a main dealer, but most cars are serviced / repaired at road side "garages" by which I mean some make shift ramps on the side of the road. Parts are very difficult to get hold of out there and trying to get an engineers report on something faulty may be just about impossible. Photos would be your best bet, but even that might be difficult.
I feel for both of you and it is a difficult situation. Hope you manage to get it resolved amicably.

Hi All,
I am the other party involved in this saga and i have only just been informed of this thread by Darren.
Firstly, i would like to state that i am in no way blaming or accusing Darren for selling me a buggered box knowingly - and i am sure he will testify to that. He got the box of an accident car, had it sent for refurbishing and never got a chance to test it as his car is in the middle of a build. So he would only have the word of the company he got the work done at.
In my defense i would just like to say that i have been a member on this forum for 2 years now and i have bought parts from many different members on here without issues - always working on a trust basis as i am based in Kenya and i know that not many guys are comfortable dealing with us "foreigners" as someone put it in one of the posts. If anyone requires references please feel free to ask. Like all my other purchases, i wired the money for the box (500 GBP) to Darren (whom i dont even know) in good faith before it was shipped out. I'm sure not many of you sitting there talking smack about me trying to rip a bloke off would even consider doing that. But as i said, i am a straight forward guy & i operate on trust.
Anyway, here's a quick flow of events:
The box was to go on my version 3 STI Type R. On fitting it, i could not engage reverse & all the other gears were going in with difficulty. I put this down to the box being dry for a long time so let the car run for a while. I then took the car for a little run and also realized that the bearings were whining! I took the car back to the garage and we put it on the lift and drove the car in the air on the lift to make certain that it was the gearbox whining & not the rear diff. It was the box. Luckily i had a another STI box handy & was able to fit that instead. I didnt open the faulty box as i did not want to be accused of tampering with it if i was going to return it. So photos would have not told much of a story and i didnt think of a video at the time as i was really put out over the situation & i just wanted my car on the road as i had only a week to go back to work in Sudan.
Now, i dont know what some of you guys think Africa is but the level of ignorance and stereo typing shown in this thread is astounding & shameful! I would have expected this from an American forum as those guys couldnt point out Africa on a map but not on here. Anyway, i guess i stand corrected thinking chaps in the UK were a bit more sensible. I dont blame anyone though as it is the moral climate of this day and age that tends to foster such stigma.
Anyway, the garage i get my car worked on is far from a " road side garage with make shift ramps"! Its a fully kitted workshop & they specialize in Subaru & Mitsubishi rally preparation. The owner was also a WRC appointed scrutineer when the Safari was a WRC event. So the boys there know what they are doing.
On contacting Darren i explained to him what i had found & he was very sympathetic and apologetic over the issue & said he would work with me to have this resolved. He suggested that either i send the box back, or have it repaired & he would pay for the repairs. I got a rough estimate from the garage as i did not want to open the box yet in case i would still have to send it back. I was given a quote of nearly 50,000 KSH for new bearings, links, selectors etc for the box & labour had'nt even been added as yet! So the cost to repair was coming to nearly 500 GBP. Sending the box back would cost me 500 GBP as well! So i was basically up the proverbial creek without a paddle. Darren thankfully agreed to settle on a figure of 300 GBP toward the cost which i accepted & appreciated. I was to receive this on the 15th of this month & now on inquiring as to the status of this i have been asked by him to provide proof/evidence etc etc as some of you have advised.
I have emailed him and explained to him that i am back on the job now in Sudan & not getting back home till December. Plus for a full report and photos/video i will need to remove my existing box, put on the buggered one, remove it again and replace with my working one again...... its just to much hassle for me for 300 quid & not worth the effort. I guess its a lesson learned. I've had more good experiences with this site than bad so i'm not going to moan about it.

All I am asking for here is either the box being returned to me for a full refund which I am completely happy to give or some kind of proof that it is indeed faulty.
I'm not saying I wont give him a refund and nor have I ever said that.
What I am saying is I either get the box back in my posession for a full refund or i get some kind of proof that it's non functional for a part refund.
Please tell me how I'm being wrong or immoral with that.

As i explained to you - it will cost me 500 GBP (maybe more) to get the box back to you only to receive the same back. Does not make sense. As for evidence, it will still cost me a lot to put the box on the car so you can hear the bearings whining. Pictures will not tell the story.Maybe if my current gearbox gives up and i need to replace it i will have to get the one i got off you repaired and maybe then it will be viable for me to do the necessary.

But to set things straight. I've been a member on here since 2000 sold countless items on here and you have picked out the three I've had problems with which incedently all ended up being resolved. Thanks for your input

If I was the seller I'd say bu&&er off and if I was the buyer i'd be pi$$ed off and want money back. From a neutral point of view though I'd have to go with the provide proof to get the part refund or return the box for a full refund. One thing that's not been mentioned is could the box have been damaged in transit which if it could be proved would surely be down to the shipping company.

Transit should be the responsibility of the buyer (unless agreed otherwise). The rest is down to if the item is not fit for purpose or as advertised, purchase price back or fix imo.
So.... if the box is suspected to be kanckered, send it back if you are not happy, but you pay the carriage. If the box is knackered, you either have the choice of a refund on the box price (you get no "sending" transit costs back) or you have the seller repair the box and send it back, all FOC. The only sticking point is whether or not you think, assuming the box is proven to be mullered, that you also get a refund on your "sending" transit costs.

Well to be fair, as someone who has worked and travelled extensively in Africa, what I was suggesting is not at all uncommon. You are obviously very lucky to be in a position where you have top quality facilities and mechanics at your disposal. My previous wind up posts aside, why isn't the garage that rebuilt the box being questioned. Does it not sound like the box was paid for to be rebuilt and the box was either rebuilt badly or not at all.

Is there a receipt for the work done?
If the buyer agrees it’s not the sellers fault as he didn’t know it was faulty it’s also not the seller’s fault you live in Africa.

I do have a reciept for the work done. Have already been to discuss this matter with the company concerned who are a transmission specialist. ie All they do is work on transmissions they are not a garage that do a whole range of car repairs.
They have said they are quite happy to look at the box but what can they do exactly without having the box there to look at? Or pehaps they should give me my money back based on my word like i'm being asked to do????

Thats a bit harsh. You said its possible that the garage fitting the box is a bit shoddy. He points out that it isn't and you take away any support for him.
