My neck is playing up a bit today so will be giving my insurance company a call.

That's not entirely true. I recently had a non at fault claim and the cost of repairs came to over 60% of the cars value. Basically, its your insurance company covering themselves in case the 3rd party insurers decide the bill is too high (compared to value of car) to pay.

They will still fix your car IF the 3rd party insurers agree to pay the bill.

I feel that in situations like this they should pay the bill as I am totally not at fault. Due to the third party not pay attention or whatever the excuse maybe I now possibly face loosing something that I have worked extremely hard to own and spare no expense on maintaining. I know I am biased in this situation but why should I suffer for someone else's mistake. I know people will say get a settlement then buy another but everyone knows that another car cannot replace your own one.

I felt the same. If the other person idmits liability then theres lots of options to fix your car before you go down the settlement route. You could even get your car back plus money from the insurers and get it fixed yourself.

They didn't offer to do that at the scene and said that they wanted to go through the insurance as they are covered on their company policy. I'll have to wait and see how it turns out but am preparing for the worst, that being I won't be owning another Subaru.

Its very important when making a claim that you state they admit liability.

Haven't the 3rd party insurers rang you yet to discuss helping you with your claim?

They didn't say that but I spoke to my broker who have handed it over to a company who deal with claims when it is almost defiantly not the drivers fault. They are contacting the 3rd party to get them to admit liabilty. They have also arranged a hire car at no cost to me. I'm lucky as I was stationary and hit from behind when stuck in traffic so I can't see how liabilty can be argued.

Quick update. An engineer assessed the car today and has confirmed that it's a write off. Gutted!!

Another update. I have agreed a settlement figure of £4950 for the car which includes me keep the car.

I'm not going to be breaking the car as I go not have the experience to do this or the time or place to store the parts.

I am looking to sell the car as it is and have had a couple of provisional quotes around the £2k mark. Should I hold out for this or am I setting my sights too high?

I would take the 2k tbh, winter is coming up and you will just have a rusting wreck outside
You only paid 6k (version 4?) and you will end up with nearly 7k in your pocket, not bad going that

That's why I've accepted the £4950. I haggled with the insurers but the stuck firm but I expected them to and as you say I only paid 6k for it so not a bad price really after selling the remains on. If they turn up with 2k I'd snap their arm off. I'm not convinced they will though as they said a rough price. What would you say is a fair price for a quick sale? I don't want to get ripped off as I know there's a fair bit of money in it.

£5k in your pocket, plus the damaged car to sell on?

I'm sure there is plenty breakers that will have it off you for instant cash, or try listing it on here.

As for your Neck, have you informed the Insurance Co?

Well still waiting for liability to be admitted which I can't believe but yeah 4950 then what I sell the car for. Have got a solicitor acting for me regarding the neck so extra money there as well once that is settled. All in all a positive outcome but as I'm sure people will appreciate it's not the same as your car.

I'm trying various breakers now so will see what happens. Possibly considering eBay and here but would prefer the simpler route of a breaker picking it up as need it gone asap as it's clogging up my Nan's garage. Lol.

never ever accept the insurers first offer...unless it's really really good! from my experience, i was offerred a low valuation on my cat b write off sti and by providing them with evidence of it's real value through ps/autotrader ads etc they raised their valuation by £700...only just short of what i paid for the car. so long as your very very patient...took 6 weeks to sort mine out...and very polite and accommodating, i am sure they will pay you a fair value.

of course, you can always ask to buy back the vehicle at salvage cost, although i am not sure how this will work if its more than a cat c write off. don't give up, stick to your guns, give them loadsa evidence, speak to their engineer/loss adjuster...it will all help. good luck!

Well I refused the offer and was told they wouldn't move on it do have settled got £4950 and keeping the car. Once I sell the car on I will get back what I originally paid for it so I'll be happy with that.

If the payout is by another insurance company, aka not your fault, the car still belongs to you.

I've accepted the offer now so waiting for the settlement. I'm happy with what I got taking into account I have the car to sell. I need to get it all sorted asap as the car is taking up space and I need to get another car. Shame it's not looking like being an Impreza.

Ok, been here - I declared by graphics on my first scoob, which was written off by idiot who failed to give way (not me). Even though I wasnt claiming against my own insurance company, they do speak to each other and mine said I hadnt declared the graphics so the other one said they wouldnt pay out Fortunately I'd written down all the details, date I declared mods, who I'd spoken to etc, I argued no end and I got a decent pay out because the car was immaculate with loads of receipts. I got more than I would have ever got selling it. I took the money and traded up, it's a buyers market

BTW, I got the same amount again for a sprained neck as I was hit side on and he didnt attempt to slow down - bad at the time, nice when the cheque came through

Well insurance was the main culprit but I'm now in second minds. You must be physic as I've just been looking at bugeye's on Pistonheads.

I've been looking at Focus RS's. Like the look but only 212 bhp standard so a big step down.

Well I declared the only mods I'd made being a stainless exhaust and they were fine with this. At the end of the day I don't think that £4950 and the car was a bad price for a version 4 Type R. As you say I can now look to buy a newer car which I was planning to do in the future anyway. It's also forced me to buy a smaller car which I wanted to do to save mileage and costs. Looking at a Fiesta tomorrow so if it's good then I'll keep it as a second car when I get the new car whatever it may be.

I've got a claim for personal injury going through as well so see what that brings me. The vechile I was hit by was a cement mixer and I'm still getting pains in my neck.

All the responses have been consistent in value. Waiting on people to inspect but I'm still open to offers so I'll PM you the offers I've already had.

Heard from my solicitor and they have heard from the 3rd party who have admitted liability. Will no have to chase up the insurance claim to see if they have managed to get the settlement from them.
