Lucky B*******s

It seems my problem is all down to interpretation of the term "vacant possession"

Since he is so awkward and also trying it on over the cost of removing the stuff, I don't think you owe him any favours.

As Alcazar says though, you are responsible for removing the stuff so you will eventually have to do that.

It refers to the house, not your head Funks!

I think the bog seat thing is the way forward. Go up with a bunch of mates and shift everything non permanent that will cause maximum pain. that includes any lightbulbs you recognise.

Tried appealing to his better nature but he wouldn't have any of it so I told him I'd remove my stuff in 5 weeks, as it was the earliest I could get up there, I think he's phoning his solicitor.
i think you are mad tbh and would seriously think about what you are doing

can't you speak to your solicitor who handled the sale for you

I was clearing out the house I had just bought years ago and the previous owners had left a few items in the loft. Nothing major apart from the rather large pink ***** !!!

Not much help to you funkii but just in case you needed to remove any *ahem* specialist items you may have left

I told him I'd do it in 5-7 weeks once Mrs Funks has our impending munkii, I wasn't prepared to be over 50 miles away from her at this time, just in case.

I asked my solicitor about the contract and yes I have an obligation but he also suggests Mr Patel is ripping me off at £350, and who's to say he doesn't come back in a months time with another issue, kind of like he did during the sale without stereotyping he is your typical Indian haggler wanting something for nothing.

My solicitor does not think he will go to the small claims court as it wouldn't be worth his while.

Anyway I'll ring him in 5 weeks and see if he still wants it shifting, hopefully he justs ***** off now.

agreed as I said earlier. I can't believe what a soft touch some people are...if it was with in a day of the sale then ok but 2 months??? you must be mental!

once he knows you are soft then he will never stop, give him an inch and he is going to take a mile!!!

If he calls again just tell him you don't know what he's talking about and Funkii Munkii died a few weeks ago from stress, say it was something to do with a house sale...

I read this a few months back not to much different! http://forums.moneysavingexpert.com/....php?t=2344119

Not my choice B2Z, if I was selfish then I would still be there living the dream, blame the wife. As I told her I'm in BJ credit for the rest of my life
Sadly I think she's closed my account

Dont worry I'm baiting them from afar

SS - no chance I'm going soft on him, I was just being polite, short of it is I dont mind removing the 5 items when it suits me but for him to suggest the insulation has to be removed was a laugh I reminded him it was his house now and if he wanted new insulation then he removes the old.

i would make a note of the Insulation comment btw (times dates etc) -- good ammo if you go to court as it shows he is being totaly unreasonable

and I would be demanding some back door action aswell

Offer to fit the new insulation for £350 and then take a skip load of fresh fish round, which you should accidentally leave in the loft to rot.

Who's to say he hasn't added to whatever is in the loft? You could find yourself moving the remnants of an Honour Killing!!

Unlikely I know - but I'd take advice.

My old mate Mr Patel is still up to his tricks.

I got a final demand from Thames Water for £40. When my tennants moved out they paid up in full. Mr Patel told TW he moved in on Oct 1st hence they flicked me a bill for £40.

I have advised them we exchanged at 14:00 on August 20th and he had his builders in as of that date.

The cheeky B*stard is trying to get me to pay for the water his crew used.

So glad I never went back to take those 5 items out of the loft !!

Do you have a written contract between yourself and the new owner stating that they would be liable for bills between exchange and completion?

If not then your exchange date is completely irrelevant to the utility companies, they will be only interested in when you completed.

also if this guy was buying off me, just before i leave for good i think some milk poured on all the carpets would be ideal revenge.. a couple of days later and you wont be able to stand in that house! that'd teach him.

If the new owner's builders began working on the premises on the day contracts were exchanged, doesn't that suggest completion also happened on the same day, or very soon afterwards?

A bottle of milk broke in my dad's (RIP) car many years ago, and the contents soaked into the passenger footwell carpet. It was the rankest stench I've ever known. The reek stayed for about 6 months!!! (despite desperate attempts to clean it up!). Made me gag.

it could be that the purchaser was v v v pushy (sound like it tbh) and got the OP to agree to work being done on exchange of contracts, even if there was a gap between exchange and completion - some people try it on, they don't seem to be able to stop - ever

my first advice stands -- tell him to fvck off

I suspect he falls out with every tradesmen he ever deals with too, these people always do
