Is there anything in the advert that you could get him on. If the car is not as described you may well be able to claim against him. Do you have family legal protection on your house insurance. What you would need to do is prove that he misled you and the car is substantially different from the advert and not having the correct engine is substantially different..

Is just over £4k a fair price for a Type R of this age condition etc ? or is it cheap? because often when something appears to be a bit of a bargain and to good to be true it's often because it is to good to be true, it's easy to overlook / ignore tell tale signs in the hope of grabbing a bargain, I'm not saying this as happened here it's just a generalisation, and goes to prove the old adage ‘buyer beware’.
It’s also very unlikely that you’d have any success reclaiming any money, I think you would need to prove an intention to deceive, the vendor would simply plead stupidity claiming not to know, it's a pisser but unfortunately I guess all you can do is put it down to experience.

the only legal aspects to a private car sale is that the person selling has proper title to the car and as someone above has mentioned, the seller must advertise it correctly...i.e...not advertised as a scooby but is a clio for instance. feel bad for you mate.
