yeah £100 as a good will gesture,he drove it sensibly to avoid it slipping and also told me not to thrash it so out of respect to the owner i test drove it without pushing it hard.im just too honest and too damn nice!

Sod talking about being honest and to nice...He pulled the wool over your eyes fella, deliberately misled you. He knew the clutch was fooked hence his clutch thread, you have him bang to rights.

I think hes a minumum of £200 of the mark there. if he does not come up with the cash I would seriously consider taking him to the small claims court. dont worry about him changing posts as stuart and the web team will be able to provide you with original posts with permissions from court.

hope you come out of this with a clutch paid for and the car that was advertised.

ay,how can u know anything about a second hand car?? thats wot the honest owners for to tell u about the car and be HONEST!!!!
he respected the owners wishes and didnt thrash his car on the test drive and discovered the fault on the way home.

By this post i guess your siding with the seller? are you friends or just cut from the same cloth?

The bottom line is the seller knew about the clutch but failed to disclose this in his for sale ad......"drives 100%" is one of the first lines he kicked off with, which we now know to be total bollox!

This vehicle has run as sweet as a nut since the day it arrived from Japan and despite the KAKIMOTO exhaust, it is not over boosting at all!

Rich you dithered around for ages trying to find something to talk your way out of buying it?

3 large men in the car during the first road test, gave it a good blast and the clutch never slipped once and despite my previous posts I had no idea it was about to go.
For a long time I was thinking about up-grading things on her, I was coming to the point of doing so if I did not achieve a sale!

When we arrived back from the test drive there was very little steam coming from the front edge of bonnet, however nothing dripping underneath.
I explained I had given the vehicle an oil and filter change and topped all the levels including the water for his long journey home. Maybe I had over filled things?

I then went on to say if you are unsure about things don't buy it, I'm not bothered as I had someone else lined up for it. I then went on to say - lets all get back in the car for a good drive down the motorway to satisfy our selves that all is well. Cruising at 70-100 mph to make absolutely sure all is well.......we arrived back at my house and not as much as a drop of water/steam or even a hint of slippy clutch!!!!!!

Rich looked at me with a big grin and said he would have it and he was very happy with the car. I was also convinced all was well.

I still went on to say are you sure and convinced you want it, as I was not bothered one way or another if I sold it. He couldn't wait to get under way.

A 13 year old car can spring a small water leak any bloody time and as long as you don't cook it...... so what. I must also add the clutch never juddered either.

I don't like being called a liar and I certainly didn't force him to buy it! As soon as he started texting me down the motorway about the clutch, I was dumfounded and upset for him. I then offered him some fund's, you've blown that!!!!! A clutch plate is a service item and not a major mechanical fault. Get a life mate!

the car was driven specifically during the test drive without flooring it as you kept stating not to give it some.i knew you were not intending to pay the good gesture anyway,im usually a good judge of character,and i was right unfortunetely.no hard feelings as i already know what ive done,and you wondered why i was so cautious???never mind my loss! and my fault.the car is very good and im happy with it but i do think you knew about the clutch going!

im just being honest,the first time i put the throttle to the floor i thought wow,he didnt boot it at all on the test run as it went about 5 times quicker.i then realised why you didnt give it loads of beans because of the clutch,i did also think it was abit odd why you were so adamant for me not to boot it on my test drive.nevermind mate,i dont want to fall out as i like the car anyway.just a shame because i do think you were aware of it,i had that feeling the whole time that you were trying to hide something hence why you were telling me i was trying to talk myself out of it,i would have still purchased even with a slipping clutch at a slightly reduced price,i wouldnt have asked the world as i know the car is good.just a shame thats all and seeing the previous posts just all tallys up im afraid.no worries tho.

it even slips in 2nd gear,its not something thats just happened,its been slipping a while now mate hasnt it?

Come on that's hardly fair is it. The guy bought the car off of you in good faith and didn't drive it hard on test drive (to be fair who does?) and you knew that the clutch was on it's way out.

Do the decent thing and refund the guy the cost of the clutch.

At the end of the day dude as you say you are happy with it and thats the main thing really. I bought my scooby 2 months ago off a really good bloke who even after selling it to me still made contact a week later to advise which oil he used everytime he changed it and sent me more of the paperwork for the motor. However i also discovered it had a bad slipping clutch and this is now due to be fixed this week. The bad news.... yeah it might cost you 300 sheets to have fixed but the good news is you KNOW it has been done and will last another 80k! And like me, when its fixed you will feel like driving a new car when that boost kicks in HAHA So enjoy the scoob, look after it and GET SOME PICTURES UP!!! ;-)

i am not siding with the seller but i have seen no evidence that the seller knew the clutch was knackered, only a post about looking into a upgraded clutch.
I think the buyer would be very lucky to claim agianst the seller and im suprised he didnt keep communications plesant and accept the £100. it was upto him to test the clutch.
could you not have tested it by putting it in fourth and flooring it, or by its bite point or by putting it in fourth and letting the clutch up on the handbrake?

I'm finding myself on the fence with this one too.

There seems to be a few jumping to conclusions without hard facts, rather just written information put up by a disgruntled seller and buyer.

I would say to the O.P... get the clutch fixed as per your other thread as well as the radiator changed (happened to me on my old classic) and you'll have it in the knowledge they're new and will last for your ownership of the car.

To the seller I would say it wasn't the best response saying you will refuse a partial refund which you previously discussed and agreed upon. Certainly does no favours to your character.


I would suggest those just throwing pathetic comments like "*****" about leave these two guys to amicably sort a solution out. Again, it makes you look immature and unable to hold reasoned debate
