J Sainbury's make a mistake..

I'd just leave it, look on the funny side (you got to admit it's funny) anyways the TV is obviously not dissatisfactory to you having happliy (I assume) watched it all year. I actually prefer LCD to plasma anyway

are you seriously saying you didn't notice the washed our colours, terrible ghosting on fast scenes, backlight bleed or grey blacks for a YEAR
I recommend you go to specsavers rather than sainsburys
Honestly though mate, all joking aside I'm absolutely stunned you didn't realise your mistake before now. LCDs are awful compared to a properly calibrated plasma. Perhaps you should think about selling it on and buying one of the new 2011 Vieras?

working for a major TV manufacturing company for over 7 years I will give my 5 pence,
You appear to have got the wrong tv, you were clearly happy with the TV until your friend pointed out the difference, only then you were unhappy.
it is a fact and the general consensus after market research that most people prefer an LCD screen to a plasma, there are pros and cons on both but most people will argue an LCD is a better all rounder.
your contract is as previously mentioned with the retailer under the Sales of Goods Act, however the manufacturer has an obligation under the supply of goods act, whether you have a case after this amount of time is debateable, what is to say you have not switched the TV for another on in this time?
personally i think if you are happy with the unit then i would not follow it up the quote below is quite funny
"are you seriously saying you didn't notice the washed our colours, terrible ghosting on fast scenes, backlight bleed or grey blacks for a YEAR"
i am sure he didnt notice the above, but he also probably didnt notice the less of a clear image, less in depth colours and any noticeable image retention, plus he may have not noticed the less energy being used and heat being given off, oh and also that the plasma would statistically not last as long in hour usage then an LCD
One last thing which is worth noting is that although manufacturers claim to have a certain sized screen i.e - 26" or 32" or 42" the actual visable screen might be an inch or two less, some manufaturers have a bezel or frame which covers some of the viewing screen thus reducing the actual size of whats viewable.

If a TV was 40" lengthways it will have a larger than 40" screen as you measure diagonally NOT lengthways. Be 100% sure of that model number or you could make yourself look really silly to Sainsburys.
That said, I do think that you have a good case regardless of some of the disparaging comments on here

You have posted up quite a bit of miss-information but you'll have to wait for my broadband to be connected before I can reply indepth as I can't be bothered typing it all out on my blackberry.

**Edit**
Just been upstairs to measure my 42". It is 36.5" lengthways.

Not sure if this is the right place to post this but I've got this 42" plasma for sale. See I got this from Sainsburys last year but have only just noticed it isnt the 40" LCD I thought I bought, though it did seem a bit tight in the box.
Maybe someone would even consider an exchange.

Not to **** on your "market research" but it is wrong. When I confront a customer on why they want an LCD/LED, 90% just don't know and are just following the trend.

ok firstly the comparison is not been an LED and LCD it was between the plasma and an LCD, and you are quite wrong in that 90% are just following a trend, suprisingly people nowadays do quite a bit of research before buying a TV.
I will be happy to hear what you think is "miss-information" and would gladly discuss it

Always had doubts about the TV not looking right but didnt ever bother with it.
After confirming with my mate Barry it was 34+" sideways.
The case is being dealt by Sainsbury's head office & they are in communication with the branch.
Haha at all the funny comments.

A little update on this. I have been given a reference number & been told to take the TV & reciept to the customer service desk in order for them to process a refund.
I can have a slightly bigger screen in my bathroom now. This time round I will double check
Thanks for all the advice & kind help.
