It's not the administrators problem (TUPE), it's his, basically, hence the administrators won't be that bothered.
In terms of the order of priority of distribution, HMRC rank equally with all trade and expense creditors after employee claims for wages/salary up to £800 per employee and holiday pay.

The admins have told him to seek independant legal advice as they believe we will be caught out by TUPE
He has told them to leave us on the sale and he agrees to TUPE, he hasn't told us that though
I have just been on the phone to ACAS who told me he should inform us that we are being TUPED across however he has told us nothing. I think he thinks he just has to agree to it
I want to walk and not work in newco he has transferred me without consultation, by TUPE'ing me my contract stays and I cant go after customers
