I would be sending ebay a very strongly worded email explaining you will be passing this on to your solicitor and not only going after the buyer but also ebay as they have left you in this situation and sided with the buyer who has committed fraud.

I would try and get your case escalated at Ebay, so you can prove to them the tracking number is bogus. If my case was anything to go by, Ebay's internal rules are that they should absolutely not side with a buyer unless there's certain proof an item has been returned. If you can't get the case escalated, try and call their London customer care HQ (easy to find on Google).

My ebay account shows minus the amount the item sold for.
So basically he has the item plus a refund, I don't have the item to recoup money back and I now owe ebay the amount for which they keep sending chasing emails for.
I would a appreciate any help on this because I don't want the guy to get away with it.

This guy is at it again trying to scam me. I wish I'd read this forum first. He's deleted his old eBay account but his new one is unimaginatively called
