For business use you require a CPC if you are driving a vehicle >3500kg.
The main exemption is if driving is not your main job, and you are only carrying tools / goods to allow you to carry out your main job. There are other exemptions but few apply to general driving.
I.e scaffolder who drives to site, parks up, and works for the whole day, then drives back to depot *may* not require a CPC.
Same wagon and driver, but only takes the scaffolding materials to sites and does this all day, site to site, - does need a CPC.
If you are driving under an OL its upto the TM to ensure all drivers are conforming by 01/09/14 for LGV.
If you are driving under a restricted OL then you dont have a TM but you still need to conform.
I will be interested to see how VOSA enforce it though TBH. I expect employment contracts will be the first port of call! After that I guess they will look at tachograph use and see how many hours a day you are driving.
