Nicked at 100mph - help!!!!??

WOAH!! Be very careful about requesting a Crown Court trial. CS, You appear to have been nailed fair and square and appear ready to accept the punishment. Good luck. Crown Courts can (and will) give out much heavier sentences than can be handed out in Magistrates' Courts. IIRC, doing over 100 is now a hanging offence and you could expect a death sentence in a Crown Court

Caught speeding. (I wonder who you really are? )
I was caught doing 99.26mph in a 70 zone, I pleaded guilty by post (no solicitor) and I got 5 points and a fine of, IIRC, £280 approx.
The only differences in my case were that my licence was clean, the weather was sunny and the road was practically empty. (But then of COURSE the traffic was light, thats why the uniformed tax collectors, sorry, policemen were hiding there, and not on a busy road outside a school, for example) No offence to StuartH, I'm sure you don't do that.
Good luck.

Oh dear-good luck............(in court)
Otherwise,
1) Buy a radar/laser detector
2) buy a radar jammer
3) Buy a Morpheous Geodesy GPS Gatso detector
4) a Gideon Bible...........
Alternatively :-
5) Sell the scoob & buy a diesel (as suggested earlier)........
Hard luck

Your best bet is to move and not get caught by the police for anything. This is what I done when I was younger. I did get caught for other offences 4 yrs latter and eventually given 3yrs I was also banned for a few months for the previous offence but it did not worry me as I could not drive in prison anyway.

None of which would have any effect in this case as VASCAR is un-detectable.

YOU CAN USE THE ONLY HOPE OF GETTING OFF, BUT ONLY ONCE IN A COURT OF LAW, IF YOU GET A LETTER FROM YOUR EMPLOYER TO SAY THAT IF YOU WERE TO LOSE YOUR D/L YOU WOULD LOSE YOUR JOB, HOUSE AND LIVELYHOOD.
( CIRCUMSTANTIAL HARDSHIP OR SOMETHING )
BUT REMEMBER IN A COURT OF LAW YOU WILL ONLY GET ONE CHANCE TO USE THIS EXCUSE ( GET OUT OF JAIL FREE CARD ).

My recent experience:-
38 MPH over the limit (in a 60 limit)
6 points
£555 fine
NO BAN
This was at Skipton court who are well known for being very strict - very little crime in the area so they make an example of motorists according to the Solicitor.
My Solicitor advised me a short ban was virtually inevitable. His case to the court emphasized me needing my license for my job and my clean license (previous points more than four years old). Its worth getting a letter from your employers to present to the Magistrates.
Check with your insurance - you may be covered for legal costs - I was which saved me about £350.
Interestingly my Solicitor said you never get a Ban AND points - its one or the other and if you get a ban you start with zero points again. This seems to conflict with information on previous posts.
Good luck,
Ian.

I was caught doing 103.9 mph on the bottom of the M1 (the Met) in 1997 and got a 3 points fixed penalty (£40 I seem to remember). Couldnt believe my luck - the Met obviously have real criminals to spend their time on. Buttering up the Policeman can work - there are no fixed rules it seems.

A friend of mine that works in the motor trade was caught at 102ish. He pleeded that he needed his licence for the job, his mind was not on driving as he was on his was to mother-in-laws in hospital, sorry etc. (not sure 'mind no on driving' is good idea!!)
He got a week ban and a £300 ish fine as I remember.
Good luck, I know it's a bummer when you get done, even a parking ticket, but I'm not being funny when I say this, we all know the rules.

Hard luck whoever you were
Currently touching an entire rain forest of wood but my only penalty in 10.5 years driving is 3pts. Got caught doing 92.3mph on a quiet motorway. Still get soddin penalised on insurance though
I wouldn't mind but the wheels had just been balanced on the 205 (1.6 with solid centre wheels so costs a bomb to balance them - £10 each wheel ), and I was just checking they had been done properly. Bloody unmarked Rover coming onto mway comes steaming after me
The thing that annoys me is the appropriate speed rule. Why can the gov't not sort it out. 100mph on a quiet mway is NOT dangerous.
Jerome - hows it going m8?

Hi ,
I got a Turbo last sept and got caught on saddleworth moor (M62), by a T5 (End Of Dec) he said doing between 95 - 104.
LUCKILY he was a nice guy asked me how long i had the car etc .... / how i could afford one and I did'nt give him any crap and held my hand ups (Fair Cop)
He gave me a producer and 3 points / £60. So I feel i got off lightly. This has slowed me down and was probably the best things that could have happended.
But why can one give you a sp60 and another send you to Court? I thought they had to stick to the letter of the law?
Of is it LUCK?
Cheers
Dan

I would hope Matt that you may be off scott free.
If you did'nt sign anything then how can they PROVE they gave you the verbal NIP!
The reason why they get you to sign is so that they have evidence that they gave you a verbal NIP. No signature no NIP!
They have 14 days to serve you with a written NIP, otherwise it's no ball.

StuartH,
Just 2 comments:
(1) Am I right in believing that new legislation is now/soon being brought in to make the detection of speed detection equipment illegal?
(2) I thought VASCAR was detectible by spotting the one or two traffic officer/s in flourescent jackets sitting in/on a vehicle that could be stationary at the side of the road (maybe on a bridge/sliproad) or moving along in traffic ahead of/behind you? If you spot such a vehicle you would be breaking the law re (1)? Has the government really fielded a law that makes reasonable levels of observation illegal?

Guys,
I spoke to Andreas Serghis today about my 'problem' and basically I should expect something in the post.
Apparently they don't have to give you anything, you don't have to sign anything and they don't need to show you 'evidence' of the alleged speed.
They will use the two independant witnesses rule and the scary thing is there is nothing to stop them saying you where doing 140mph if they wanted too
His advice to me was to try and get a small ban and fine as I am in a catch 22 situation wrt my license being less than 2 years old and so forth.
He was extremely sympathetic and helpful and if the dreaded letter does come through the door I shall have no hesitation to give him a ring to represent me.
ta,
Matt

Were you in a Scooby when you were done?
If so, the magistrate must have been taking the p**s to give you a £555 fine
Peter[/quote]
Peter,
I was on my motorcycle not in the Scooby so I've no idea where they got the £555 fine from ..... then again it was a Police Scoob that stopped me.
As a mate said, it could have been worse, they could have fined me £666!
The open wallet surgery doesn't just stop at the speeding fine. I've just received my insurance renewal on the bike and when I notified them that my license was half full they added an extra £180 to the premium.
Cheers,
Ian.

Heard back - am being hauled in
Very best case scenario - 5 points plus heavy fine
Worst case scenario - 6 points PLUS 4 week Ban PLUS even heavier fine
It would appear you CAN and normally DO get points when you get a ban for 100+
Buggar
I hold my hands up as guilty, it was a stupid move, but 6 points + ban + heavy fine does seem a bit much for 0.4mph over 100
At this rate, might have to change my email address to dangerouscriminal@life-threatening-wing-wormwood-scrubs.com

Saw a guy in a local paper last week who was pulled over for using his fogs in good visability. It then turned out he was pissed, had no licence, no tax, MOT or insurance. Apart from the 18 month ban, he only got £200 and 8 points - no justice! I'm awaiting to hear on a driving without due car and attention - the worst possible is 9 points, £2500 fine and a ban - bummer.
Good luck by the way
