Sorry to go off topic but..
Looking at some of the info on this thread is it true to say that if I went away on holiday and then got take ill whilst away I could have it counted as sick leave?
So I could come back and still have all my holiday entitlement intact?

Full time, they just don't pay it and that seems to be that.
I was never off for more than 2 days at a time as I only ever took it off when the pain was unbearable otherwise I just manned up and got on with it.

- And while you are being paid your sick pay you will be earning further holiday entitlement at the same rate you would be if you were actually at work.
Got to be some benefits to the common man from being in the EU

I'm no expert mate, but I would be prepared to bet a reasonable sum of my own money that your employer is breaking the law.

Quick one for the legal beagles or employment professionals...
My wife's company has a clause in their employment contract that states if you go off sick immediately before a pre-booked holiday then you forfeit your holiday pay and end up on unpaid leave. Is this legal - clearly some people abuse sick-notes to extend holidays but for those who are genuinely ill this is surely at best immoral?

Except why would you do that. Ask for sick pay which is nearly always much lower than holiday pay. Yes, you get your holiday days back, but potentially lose a lot of money.

At one point in time, I was better off not being there, financially (not by much I must add) because my average hours were higher than my contracted hours. Both holiday and sick pay are worked out based on average hours worked.

I'm pretty sure I am paid full pay for the first three months of sickness and then half pay for the next three.
The reason I asked is that I actually became quite ill when I was on holiday once. I was away for three weeks and spent ten days of that unable to leave my bed. I had no idea I could have claimed it as sick leave.

Maybe next time you go on holiday, keep a sick-note next to that prescription in your back pocket.

Thanks, yes it was over five years ago.
I'll bear it in mind for the future though
