Put a deposit on a car, but have changed my mind.

The trouble is, the deposit was to reserve the car in your name and also to demonstrate your intention to buy the car.
Sorry but I think they are within their rights to retain the deposit.
You would probably do better all round to buy the car anyway.

What if it was the other way round, you went to pay and collect the car only to find that the dealer had had a better offer and had sold to someone else and offered to refund your deposit?
Sorry but I don't think you'll get your deposit back.

The credit card company said I can raise a dispute because I wasn't informed the deposit was no refundable, and it wasn't on the contract.

Not sure the CC Company are correct...... if you were not explicitly informed the deposit were refundable then the implication / default would be that the deposit was not returnable.......
The contract of sale failed because you didn't cough up the cash to complete the contract......
Not sure how the CC can get you out of that one?

From previous experience the dealers I worked at only ever gave the deposit back if the car was unfit for purpose.
If you talk calmly to them & keep a cool head & try to explain a good reason why you don't want the car (Not just that you had changed your mind) they may feel sympathetic & give you the deposit back or part of it at least.
When I take a deposit on a car now I tell my customers that £50 is enough for me to hold it for them & that if they do change their mind then they don't get that back (Just covers my cost to re advertise the car again)

Just been to see him. NOT a chance. He's right of course, the law is on his side. Ah well, i'll just have to put it down to experience.

There is an understanding about putting a deposit on an item. You have entered a contract in which the dealer keeps the item for you and you assure the dealer that you will buy and pay for the item.
If you break the contract you cannot expect anything different from losing the deposit.

Frankly I'm quite surprised that they didn't just return the deposit as a goodwill gesture. (Assuming they haven't incurred any costs)
I've done this a couple of times over the last 20 years when I've left aa deposit and very soon afterwards had a change of heart. I've politely explained this to the dealer and they've returned the deposit no questions asked.
