uprated TMIC with splitter....

Have been thinking about getting an uprated i/c for a while, but here's my "dilemma" :

I own a 99, still running with the original i/c and a Zerosports i/c splitter. Now if I would put an uprated i/c, let's take APS as an example, would the splitter touch the new i/c as the core lies "higher up" than the OEM one?
Do you get what I mean? the original splitter is made of rubber and would simply "flex" when the new i/c lies higher up, but the hard, aluminium splitter would probably destroy the fins when I slam close the bonnet, no?

Or are all aftermarket i/c's designed that they lie at the exact same position than the oem one?

The reason I ask, when I look at pic's of i/c's they seem to not have this border around the core as the oem one....

APS one sits much higher, especially when you tilt it a bit too. Just trim the splitter and rubbers to suit.

I suppose all aftermarket i/c's sit higher then??
