exhaust and mot

ive only just got my 2001 buy eye wrx
its due its mot now and as i went to book it in the chap said he couldnt garantee it would pass cos of the exhaust.
its only got a backbox on it i explained not like a cat back or that. i thought the backbox was just like a noise reduction part , as exhaust gases have already gone thru the cats
should i be nervous of an emmisions failure as i dont really fancy having to buy a standard a play a swapping game once a year....

Provided it's just the backbox that's non-standard, your car should go through the MOT fine. As you say, the gases will already have gone through the cats.
Or, to put it another way, if your car does fail on emissions, it won't be because of the back box.

Exhaust noise is such a grey area, basically there is no noise limit for a mot but a tester is supposed to compare it to the noise level of a similar box in average condition. So really if the tester wants to be an **** he can. But with yours if it's just a back box then you should be fine I think the garage were just covering themselves. You could always take it somewhere else. Where are you based?

Strictly any mod to the exhaust such that its louder than a standard car is both contrary to construction and use regs and an MOT fail, MOT testers are reasonably generous (some deliberately ignore that rule) because of the lack of referance or permitted test equipemnt but the old bill are progresively starting to clamp down, Northern constabulary in Scotland are the most oppresive.
