Default cutting out

Just tried a wrx wagon with prodrive from new on a 05 with 100,000 on the clock. The thing is it sort of cut out on full throttle in 1st gear then did it with more notice the 2nd time. In 2nd, 3rd, 4th ect theres no problem. No lights on dash and when reving while stood still its ok. The fuel warning light was on but if this was a problem with pick up, surely id would do it in other gears too.

Any thought to this or should i walk away.

Modified exhaust? Could it be fuel sloshing in the tank? Needs to be filled up with a few more litres of nice super unleaded then try. Any other opinions?

When it cut out it was instant like electrical or some sort.
Not the sort of feeling when fuel is low. Not a plug or lead as it would kept going with less power.
