License points and insurance

Does anyone know why insurance companies always ask you "if you have and driving convictions in the last 5 years sir?" when the points are wipped from your license and police records after 4 years?
This doesn't seem very fair to me.
Anyone know if this is legal practice?
Just another fine example how those greedy buggers are cashing in on us poor motorists.

Don't worry about it too much most companies will either let the 1st 3 pts go with no increase in premium or stop increasing it after 2 or 3 yrs, the higher percentage of insurance companies will not take notice of them after 3 but still have to ask "within the last yrs" as years and years ago thats how long it took for them to be taken off you licence.
