Accident 20 weeks ago
Hi all,
My car was hit 20 weeks ago by another car when it was parked on the side of the road. It is being dealt with by a third party non fault claim company (helphire). I still have not had it back. Do you think I would have aclaim for compensation as a repair should never take this long.
I have paid insurance and tax etc for 6 months, plus the inconvinience.
Thinking about going to a solicitor.
My insurance company advertises on here.
Any advice appreciated.

I would be seriously p1ssed if it was my car, 5 months-how much damage was done to the car? Anyway as far as the inconvinience goes, you should not be inconvinienced in any was as they should have provided you with a courtesy car until yours is back on the road. The third party would pick up the cost of the hire car and its something you are entitled to.
You should definately chase up the reaason for the delay to your car tho, ask the insurance company for a contact number for the bodyshop it is at and speak to the bodyshop directly yourself, they will know exactly who's taking the pee.
It might be worth getting your own insurance company to chase the claim up for you as that is what you pay your premium for.
Hope you get it back asap.

Yes I have had a courtesy car for the duration. And I have done everything you suggested weeks and weeks ago, but still it is not done. Damage was suspension, refurb wheels, and radiator, next to nothing really. The problem lies with the incompetent people and companies involved in the process. A competent specialist would have turned this car around inside a month, tops, I would have thought. Problem is, helphire, the compant who are dealing with it are making money every day I have a courstesy car on hire at £172 per day!!! yes per day, multiply this by 20 weeks and that's a lot of profit out of a Golf.
Knightmare, I don't even want the car any more.

P.S it has been taken down to Powerstation, at last after 20 weeks. I suggested this at the start and a few weeks in and they refused. Costs are over £7,000 now for a MY99 + the hire car, now I can see why our insurance premiums are so high, insuance companies even rip each other off at our expense.

However.....it is probably the case they were waiting for the ok from the other persons insurers before repairing the car, in which case there isn't an awful lot Helphire could do, as they are not able to force the other persons insurers to make a decision any quicker

Why arnt you payin for the repair and chasin the other insurers to recover your costs thus minimising any inconvieniance to the customer. In 5 months you could strip a car to the shell and rebuild it what exatly are we payin for with our hundreds of pounds each year

Yes but if the other insurers have claimed liability why should he have to pay anything and claim it back like i said you pay, guy gets his car back you recover money from them and customer happy and due to the length of time his car has been away i thought you would do it out of courtesey after all if his insurance is paid up you have had 5 months when the car has not even been on the road.Will he get a a refund will you extend his cover for 5 months at no extra charge

But why would you have had over 5 months of risk free insurance premiums from this chap while his car has been laid up.
This is my suggestion.
1) phone customer and tell him you will pay for his repair and claim costs back yourself and assure him he wont pay any excess or his premium wont go up on renewal.(these 2 issues alone are probably why he hasnt claimed on his own policy)
2)Extend cover for a peroid allowing for repairs ie if his car is out of action for 6 months allowing 1 month for repairs entend by 5 months.
3)Return car to customer fully valeted.

Just seen your post and the problems that you've experienced, along with MoleyWRX mentioning that you were covered by someone that "advertise" on here.
I have trawled our database and also checked our diary/complaint log, but cannot find any note of problems of this nature.
Which presumably means that youre not currently via Greenlight and it must be another advertiser on here.
The guys on here are offering valid opinions, but if you need a hand or some impartial advice, simply PM me.

Thanks for all your comments guys and support. I am pleased to say thay my broker has agreed to refund my premium for the last 5 months, not much i spose, but better than nought. Wouldn't say that I am very happy with the service given by my broker though. Cheap isn't always good if you don't get a good service when you need it. They have a particularly aggresive operator as well, who wants to just argue with the customer instead of listening. I may prefer to pay a couple of hundred quid more, at renewal time, if it means a better service in the long term.

Just a quick update, I have now been waiting over a week since I was promised it back, (after 21 weeks) beacuse the incompetent garage only ordered a new undertray last week, even though they new it was broken. these are the sort of easily avoidable problems that have been goung on for nearly 22 weeks. They only order each part, when the last one is fitted, unbelieveable, I know.
I am deffo going after compensation if legal advice I get think that I have a valid claim.

Good news folks, I got my car back the other day after 22 weeks, yes 22!! Seems to be ok so that's good. Unfortunately, HELPHIRE who organised the repair don't understand what my problem is with waiting 22 weeks, they have told me to take it up with the garage who did the repairs, they don't want to know either as I wasn't their client, helphire was.
I know I have no backing from a legal point of view as no offence has been committed, but thought I would contact the insurance ombudsman to see what they think. At worst I would like an explanation or apology or even if they only accepted there was a problem and they could learn from it. But they are not interested one bit about my opinion. I'm absolutely amazed about the whole thing.
