Default Parking eye fine

Last month the wife parked her car in a car park in town.
One payment machine was marked out of order and the other took her money but wouldn't do anything after that.
Anyway she left the car for twenty four minutes than left the car park.
Today we've received a parking charge for £100 which I'm not too happy about.

I've looked across the net and there's pages of complaints etc so can the NSR massive recommend a course of action, I can appeal but not sure if our word against there's will cut it.

If I pay within 14 days the charge is reduce to £60, if I appeal and fail it's back to the £100

If you are in the right you wont loose the appeal , so appeal it.

You will definitely lose the appeal. There's no doubt about that. I don't think the private parking companies even look at the appeals. They just reject them.

I don't know what the latest recommendation is. Last year you could just ignore the letters completely and they would give up. There's new legislation now that means the registered keeper must identify the driver I think.

Best place to check is Pepipoo forums (http://www.pepipoo.com/) and Popla here (http://www.popla.org.uk/receivedaPCN.htm)

Unfortunately I think Parking eye are one of the only parking companies keen on taking proceedings all the way to court.

If you make life difficult for them they will give up but it depends how important £60\£100 is to you.

Go to Pistonheads and search for Parking Eye. That should give you plenty of information.

In the past people have ignored these and eventually the parking company went away. Supposedly the law has changed and it makes it easier for them to take you to court, although I'm not sure how many actually get to court. Although for one, I'm off to court with a parking company - I'm taking them to court for them issuing a ticket when I had met their parking demands - ticket on display etc etc. I'm claiming for my time and expenses as an administration fee.

With regard to the OP, personally, I'd ignore their demands. Do not reply to any correspondence from them. The only one you'd need to worry about is a court summons, otherwise it's all smoke and mirrors from them. My opinion only of course

Can't ignore them any more due to a change in the law the POPLA site has the standard letters to send and there's more on the web about how to evade the charge.

Parking eye have been chosen as the car parking mob taking over from Interserve at our Hospital. Now that will be even more fun as it's Crown / NHS property at the moment and exempted from any charges whatsoever..........

I get these parking charge notices almost every week from either "Parking Eye", or "Civil Enforcement Ltd". I always just ignore them. However the law is slightly different here in Scotland.

Taking into account what I've read coupled with the fact we have no proof the machines were faulty I'm probably going to pay the £60 charge

Another fine example of rip off Britain!

This company are a joke, I paid years ago to park on fistral beach in Newquay and by mistake I put the wrong reg number into the machine where you pay as we was in a new car(week old) and I had parked away from the machine so could not see the cars reg, so I put the reg in and got a letter wrong.

Anyway I put the little ticket the machine printed off into the car window to display, and had a day at the beach and never thought nothing off it, 2 weeks later I get a letter from Parking Eye saying that I never paid for parking and I have to pay a parking charge.

So I wrote a letter to them explaining how I made the mistake of putting the wrong letter of the car reg in the machine and that I still have the ticket(lucky I kept it) and I sent them a photocopy of the ticket with the letter, 2 weeks later I get a letter back from Parking Eye, saying that they have reviewed my letter and said that there is not enough evidence and that I still have to pay the fine or they would take me to court.

So I looked up on the internet where I stood with a parking company and everyone said to ignore the letters as they will try and scare you into paying the fine and worst case scenario if they did take you to court with a court summons then just pay it then,, So I just kept getting letters and throwing them in the bin, and in the end they gave up and I never heard anything else from them.

But the wording of there letters are really clever, there letters have a police style border around the outside, and there wording "Parking charge" instead of "Parking Fine" because the only people who can fine you are the council and the police, and not some stupid parking company!!!

Do t even bother ringing them or appealing
Just Ignore the letters
Eventually after 6/7 letters they give up

Dont respond in anyway to them

If you are swaying that way, could you not pay the charge at £60, then appeal it? That way, you pay the lesser amount, but have a chance to get it back if the appeal is accepted????

A friend of mine didn't realise she had to pay a quid at 11pm and contested it; it went to court, she's just had to pay £400.

..........ouch! that puts a lot of ill patients who have to wait for their scans and blood tests into a zone where they might have to pay a hefty fine.

As far as I'm aware you cannot pay them appeal. If I did appeal it takes 28 days to turn around pushing past the 14 reduced fee period.

I'll pay the 60 and take it as a lesson in life......

So your wife actually paid for the parking but the machine didn't dispense a ticket and now you want to give them another £60 !!

Follow the advice on here or Pepipoo and don't give in to the bullying

Yes she put her money in and attempted to type in her car reg and nothing happened, no ticket dispensed.
She noticed the car parked next to her had a note in the windscreen explaining machines weren't working, no use I suppose when the car park uses registration plate recognition.

Anyway we've put in an appeal pointing out a few facts.

if she didn't put a ticket she didn't follow the contractual agreement. Chances are a court would find in their favour.

Mate for £60 it's not worth stress.

The appeal via email is supposed to be responded to with 14 days, if I've heard nothing by day 13 I'll pay the £60 online because as you say prolonging it further may increase my stress levels.

Personally I would pay

I got a PCN last week for driving in a bus lane in the sh1thole that is Nottingham

For a millisecond I contemplated appealing on the basis of signage etc (I genuinely did not see any signs)

But in the end paid the fine with 15 mins of receiving the letter in the post

Life is sometime too short

...bit Parking Eye are NOT a council - they are a private company trying to generate revenue via contract law - and that works both ways!!

But presumably this was not some piece of scrubland, with signs the size of a postage stamp, out to catch the stupid - but a proper car park near the town, with correct signage, marked bays, parking machines etc

They have invested in machines infrastructure etc - why should they not enforce the "contract"

The OP's wife has fulfilled her part of the contract by paying for a valid parking ticket.

Parking Eye have not fulfilled their part of the contract by providing the ticket due to a faulty ticket machine.

Tell you what, give me £50 and say that I was driving and send them to me. I'll ignore all of their letters and we'll both be happy - you 'only' paying £50 and without stress and me £50 better off and without stress ('cause I'll just ignore these barstewards)

I had to recently, ended up with me taking legal advice and they suggested the £50 fine which was now £140 should be paid, as my chances in court were very slim.

It's up to the individual, (and I know the pray on it) but my life is too busy to be stressing over a parking ticket for the sake of £50. Mine was thanks to my wife not sticking the thing down on the window very well.

That said, if I thought I was in the right, I would fight it.
