My brother-in-law just got pulled doing 102mph on the M40 in his Legacy, what sort of penalty can he expect ?

Bit of a 'how long is a piece of string'

I have heard of fine + ban + points, but also big fine + points for much the same offence.

Depends on circumstances, really.

Agree with Steve, but as an indication

I know a couple of people who have been pulled for 106mph and 108mph and got away with "only" 6 points and about £1k fine. Then again, in some places, it's 28 day ban for more than 30mph over the limit.

My guess - if the road was fairly empty, weather good and/or he had a clean license before, etc, will probably get about 6 points and a big fine. If crowded, raining, or he has points already, 28 day ban. If he has several bans before, and it was raining and rush hour, maybe longer. But don't quote me!

Thanks for that.

Prevously clean licence, not very busy, mid afternoon, dry and clear, downhill, needs car for job... so hopes for a fine and no ban !

well if he needs a car for his job then he shouldn't have been speeding - sorry but I think that is one of the worst excuses for not getting a ban.

Maybe, but I guess you have got to look at the effect the punishment would have on an individual basis. The same punishment applied to two individuals may have completly disproportionate effects. I'm not trying to justifying anything but taking an individuals circumstances into account seems to make sense, including those that can affort more get a bigger fine.

Can go with the "use" thingy, But have to disagree violently with the fines: Does that make it OK for poor folk to speed then??
Or rich folk 'cos they can afford the fine?? No, one fine for all is my answer, and if you don't want one, don't speed.

You missed my point entirely - I never said it was OK for poor folk to speed What I was saying was if Mr Beckham (for example) gets caught speeding and gets fined say £5,000 he wouldn't feel a thing, where as a person of lesser means (ie most of us) would probably have to sell the car to pay the fine - an extream example, but who gets hurt the most ? I also said I was not justifying the act of speeding for those who can afford to do so.

I got banned for 102mph on the A34 a couple of years ago. 21 days plus a £200 fine...

When I went to court a number of years ago for speeding I had to detail all my income/outgoings and present it to the magistrates before they saw me. I would say thats a pretty good indication of them working out a means related fine level.
The guy before me was doing 106mph on the M1, got 6 points £300 fine no ban. I was doing 89mph, but unfortunately was towing a trailer at the time and got 5 points £350 fine no ban. Friend was caught at 147mph on his bike, got 28 day ban, 6 points, £600 fine.
I personally would rather volunteer to pay more money in a fine than have points on my license, but thats just my opinion, no need to flame me for it!

I am awaiting the result of being done for 110mph on the M6.

Will let you know but it sounds like I will be getting 6 pts, hefty fine & a ban of up to a month, should be similar for your mate.

A lot of people seem to think that 30+ over the limit is an instant ban - its not and depends on circumstances. I got caught on the bike at 38 over limit (98 in a 60) and got £555 fine , 6 points but no ban

See if legal cover on the insurance covers for a Solicitor - mine did. Get a letter from your employer if car is important for job.

I got done doing 114.3 on a clear motorway when it was sunny and dry.

With a solicitor, a letter from my company and a clean licence I ended up with a 28 day ban, a £250 gine and £50 court costs (and the solicitor fee).
