as above.

today i was driving over the fenick moors which isnt the best road in the world sitting at about 40 as its a busy road, I hit a crator in the dam road [img]images/smilies/mad.gif[/img]
I inspected the damage and I have a bulging tire and a damaged alloy

Could you please email a copy of the letter that you used and I am sure there will be a few pints init for you.

Sorry to hear that I did ask about that when I was getting my last one repaired and was told by the place doing the repair that they did not know of anyone in the Glasgow area who had successfully claimed so I never bothered on any of the 4 wheels I reshaped on the roads around here.

Sorry i've never claimed myself so i can't over any 1st hand advice. However a friend of mine claimed for the same thing when he hit a pothole and had no problems getting reimbursed for the damages.

Going on his experience.

Make sure you photograph the offending pothole and the damage using a normal camera (cheap disposable ones are ideal). Get 2 copies of the prints and send one along with the covering letter. Mention the dates and any witnesses if you have them. Also, get a written quote for the repair and send it along with the letter.

In my friends case he was compensated for a new wheel and tyre, as well as a cracked front splitter on his fiat (the cracked splitter was already there but he thought he'd chance his arm). The claim took a while to go through and he had to pay for the repair up front but it came though ok in the end. (It was with Inverclyde Regional Council in case you're wondering)

Well I did!!!
The council have a period of time in which to repair damaged road sections. As long as it is reported they must act within 8 days etc.... So Get a report made by a mate . See if they dont repair it then make a claim 10 days later.

THEY WILL PAY.

Andy claimed South Lanarkshire Council after he damaged an alloy on the back road from Hamilton to EK and they paid out AFAIK.

Will ask him for a copy of the letter and forward it to you Ricey.

Took a pic tonite in the dark with a Instant camera, the hole in question if about 2ft wide and a good couple of inches deep.

Will take more tomorrow in daylight, but the road is very busy
oh well I will just need to hold up the traffic

I have recently claimed and lost! tossers!

I was parking my car outside my girlfriends house in York and caught the kerb which was broken and very sharp which ripped my tyre, i get out and have a look and its ripped the tyre wall.
I call Yorkshire council and they sent a claim form out, i filled it in and sent it off describing what happened.
Then i get a letter from Zuric Municipal (councils insurance) sayind "although we are sympathetic to your incedent we feel it is not our fault and shall not proceed in the matter" [img]images/smilies/mad.gif[/img]

They said that the kerb did not exceed the 1cm limit for a claim, it was only 15mm out from the pavement!
I shouted and screamed, spoke to highways and solicitor but got no where!

Try and measure the depth of the pot hole before youy make a fool of yourself.

I once passed an MPV on the A303 that had had the whole rear axle ripped off by a collapsed man-hole cover. No idea about a damage claim tho...

Paul,

I took a big chunk out my alloy when the council left a cover off a drain in one of the back roads out of Cleland. That was last November and they're still rubber-earing it.

Filled out loads of forms and it's been passed around all the local contractors and they're all denying responsibility.

When I phoned and told them the cover was off (it'd been blocked for weeks), the next day it was back on and fixed. I made sure I took some pics of the road and the damage after the damage, so make sure you send some pics when you make a claim.

I did about 6 years ago (Macclesfield) when I whent down a crater & egged the sidewall of one of my week old tyres on my Golf, I had to send them photographic evidence of the damage & proof that I'd had to buy a new tyre but they paid up. It's worth chasing, if you've got a mate or a relative who works for a solicitor (my sister did) get them to do the claim.

My other half damaged the wheel on her Celica 190 last week from a HOOOOGE hole in Epsom . She came home (in tears!) and I took pictures of the damaged wheel, then changed it for the spare. She was off work the following day but took a picture the day after - by then, they had filled it!

We wrote anyway, with a quote from Toyota for a new wheel and the wrote back yesterday saying that as it had ben filled already, they don't consider themselves negligent. A new wheel is £250 + VAT (the tyre was okay) so she's not happy.

I wrote yesterday a polite and professional letter suggesting that they revisit the claim - I consider that the mere fact that the hole was filled in, suggests that complaints were made, and this alone points to the fact that cars could have been damaged from it.

I await their response but I don't hold my breath.

I wrecked a wheel in a deep pothole, tyre ripped also....

Claimed from Blackburn County Council who passed it to their insurers....

Guess who? Yup, Zurich! They wiped their hands of the matter and I goit no further, "we are sympathetic etc but not liable"

gits!

Tried to a few years ago, waste of time! If they dont know about it, they say it isnt their poroblem. Just report it so they fix it!

What you should do is use your legal cover you get with your insurance, get them to sort the claim out, they'll try and fob you off, but they won't bother fobbing off solicitors. This isn't the same as claiming off your insurance, so it won't affect your premium.

You need to take pictures of the hole in the road, give a time and date, send off the info to the council and keep bugging them
My mate had one of his wheels replaced on his mk4 golf due to this happening so go for it
