Insurance Claim for damage on Private Road?

Question

Hi,

My brother damaged his Caterham on a private road. He hit a small metal post that was sticking out of the dirt track between the wheel ruts. Sounds like it's caused a fair bit of damage to the drive-train and other bits.

He's checking with the insurance now, but what's the score on getting the owner of the road to take some of the costs? It's not a priave drive. It's the entrance to a local Steam Railway, so a company owns it rather than an individual.

Any advice welcome..

May be covered under their public liability? If the council are liable for public roads, they should be liable for theirs
