advertised it 2 weeks ago, paid for full colour 2 week add in autotrader, got a guy email me saying he wants it for sure will give me a 500 pounds deposit, so he hasnt even seen teh car, but insists it will be ok as i sent him many pics and i was honest about the state of the car, so hes due to turn up today to buy it, and i get some email saying sorry cant buy it to many other commitments now, 20 other calls have been and gone, i didnt save any numbers and now he demands his deposit back!! the fewking cheek of it, telling me about solicitors, taking me to court and deposits are refundable, what a **** is all i can say, how can some people justify fewking you about so much and still have the nerve to ask for money back?

I did speak to trading standards and it seems they are right, my own fault for giving a receipt, however i am a straight guy just trying to sell a straight car so i had nothing to hide.

Just cos i said i needed cash for the car, he also said he would report me to inland revenue and all sorts of ****.

has anyone else had this happen? really unbeleivable!!

Bad luck. If selling stuff, I always tell people "Someone should already be buying it on Thursday, but leave your number and I might ring you Friday morning if they don't."

dont turn anyone away till you have full price in your hand. if a sweet old lady says "i'll be back in an hour with your money" but someone sees it 10 mins later with cash then granny can go jump!

what even when someone gives you a 500 pounds deposit? you still treat them as a joker? not usually the way i do things

So if someone gives a deposit and you hold a car for them, then they back out, they are entitled to their deposit in full or they sue.

What happens if you take a deposit to hold a car, then sell it to someone else. You would have to refund them their deposit, but can they sue?

You should have given him a receipt informing him it was a non-returnable deposit.

spen, you are right, but being a trusting guy i thought seeing as hes giving me 500 pounds, he must be wanting to buy it, i actually wrote on the receipt that i would hold the car till today for him, it didnt mention anything about refunds though, im quite p1ssed off as he started calling me out on his own mistake, i guess just trying to get money back!!

Deduct the price of what you paid for the advert/phone calls, etc and give him back the rest in cheque. You cant get fairer than that .....

Dont forget to write the cheque to "Mr timewaster or Mr ****" and then cross it out putting his real name in. I think he'll get the message and some funny looks when he banks the cheque

and also put the wrong date on the chq, so when he goes to cash it at the bank they decline it
Don't forget admin charges, if u brought it from a dealer bet they would deduct this.

I took a £250 deposit on a car just last week and the chap was supposed to get a bank loan to buy it... he rings me after a few days and said the bank declined his loan and that i should keep his deposit.... too right i'm gonna keep it

He is not coming to get hsi money, he wants it in a cheque, he told me all dealers refund deposits, all sorts of **** lol i spoke to trading standards already they couldnt advise much but they said if i was a dealer i could keep it all.
I felt a little sorry for the guy and was tempted to give him half of his money if the other person who was interested buys it today, but apart from that as he started being abusive and threatening me with his solicitor i said bring on the court case as im a student lol i own nothing, so what can they take from me? a pound a week? bring it on

The whole point of a deposit surely is that the buyer has shown intention of buying the car for certain and wishes to reserve it. This must be regarded as a contract and if the buyer reneges on the arrangement then he is not entitled to the return of the deposit.

I took a non-returnable £200 deposit for a car I sold recently.. the buyer backed out (couldn't sell his car), but I'd turned others away so didn't feel too bad about keeping the £200

Don't worry about it mate.... often associated hassles seem to go hand in hand with selling things.....

I receieved a death threat from a young asian guy (I'm trying to sell my impreza at the moment) when I refused to drop my price from £8,000 to £5,000

After describing all the mods & history of the car, his friendly attitude soon changed when it came to the matter of money !

First he said he would come round and take the car and leave me with the £5000, then he changed his mind and said he'd take it for free... then he finished off with .....

In fact mate... I don't feckin like the sound of you ya tight Scottish c**t and I'm going to find you and f**kin make you sure you take your last f**kin breath

The heartening thing is that the car had only been advertised on Scoobynet at this point

The way I understand it is that you are entitled to deduct reasonable costs for re-advertising, but you must refund the deposit.

You could always deduct some for depreciation value.

Well, I had a lot of interest in the car, and the chap who came to see it first was adamant that he wanted it.. but said he wasn't able to pay for a month.

So I had to turn away a load of people..

I told him I'd want a non-refundable deposit, otherwise, what's the point of a deposit ? He didn't have to agree to it, he could have just waited a month and hope I hadn't sold it.

Now I'm no legal expert, but under contract law, aren't you entitled to keep it as 'consideration' for the fact that you took the vehicle off the market for him ? ie I will take the car off the market and hold it for you for 'say' £500. Otherwise, there's no point in taking it off the market.

You probably needed to make this clear before accepting the deposit, but might be worth thinking about the wording of the verbal contract that exists between you.

ok the car is sold now however im debating returning half back to him as he as such an ****. He has agreed to let me keep half of it so i feel its only fair to pay him half back, even if he was a *****

If he had been reasonable about it, fine, but if he was an arseh0le then keep his money. I recon he will back down if he has to start court preceedings etc.
